Lr:rrrned Senior Counsel for the petil'ioners submits that the petitioners are the o\,{'ner'i and possessors ol their respective plots in Sy.No.20B s.tuated at Itikyala Village and Mandal, Jogulamba (iadwal District. Tlrr: respondent No.5 has purchased tt.e said properties ttrough registered document No.309 I l2O2O, dated 20.(\tl 2O2O for a valid sale conside'ration. Thereafter, 1he respondent No.S has obtained NALA conversion ,,ide proceedings No.Cl1497 /2O2O, dated

25.O8.2O2O Subsequently, the respondent No.5 a-1so obtained la'7out permission from the respondent I'rlo.9 in Draft Tl-lr No.17 4 I 2O2OlHRO/H1 on o3.1it,.2020... a) 2 SKJ vP _1 I 143 _2021 Thereafter, the respondent No.5 has mortgaged the open plot Nos.11 to 16 in favour of the respondent No.7/Gram Panchayat under the Deed of Mortgage on Og.O1.2O2 1.

3. Learned Senior Counsel for the petitioners further submits that the petitioners herein purchased the respective plots from the respondent No.5 after forming the iayout. Whiie it being so, without issuing aly notices to the petitioners, the respondent No.2/District Coilector passed impunged proceeding No.El/56/2021 , dated O4.O3.2O21 directing the respondent No.4/Tahsildar to resume the land to an extent of Ac.O5.O4 guntas situated in Sy.No.208 at Itii<ya1a Village and Mandal Headquarters into Government custody by following the due procedure as contemplated under Land Encroachment Act, 1905 as the same is Government land.

The iearned Counsel for the petitioners further submits that in the instant case, the petitioners 3 sK. ./ wP t1'8 2421 have purchase:d the subject plots after the land corr.verted into Non-Agn<:ultural purpose. In view of the sarre, the petitioners zr-r't: the effected parties. The respondent No.2 passed impu.g:ed orders directing the respondent l"lo.4 to resume the .and by initiating the Land Encroac'hment Act, 1905.

L,:rlrned Senior Counsel for the peti,ioners submits that the action of the respondents in carLcelling the NALA co.rrrersion is illegal, arbitrary and contrary to the Rule Nor; 5(iv) and 9 of the Telangana Agricultural Land (Conve:sion for Non-Agricultural Purposes) Rules, 2006 (for brcrity 'the Rules, 2006'). Therefore, learned Senior Counsel requested to a,llow the writ petil ion by setting aside the impugned proceeding No.Ell56 l2O2l, dated 04.03.'2021.

Learned Assistant Government Pleacier for Revenue, basing on the counter ltled by the respondent 4 s1(, J wP_11143_2021 No.4 submits that the contentions of the petitioners carrnot be taken into account as subject property belongs to the Government and the respondent No.2 directed the Tahsildar to initiate land encroachment proceedings as per Land Encroachment Act, 1905 for evicting the encroachers from the schedule property. In view of the same, the respondents rightly passed the impugned orders and requested to dismiss the writ petition

After hearing both sides and on perusing the entire material on record, this Court is of the considered view that the petitioners a-re the owners ald possessors of their respective plots in Sy.No.208 situated at Itikyala Village and Mandal, Jogulamba Gadwal District by purchasing through registered documents and in the instant case they are questioning the impugned orders passed by the respondent No.2 by cancelling NALA converslon proceedings for the subject property 1n rrTroceedings No.C/ 7497 /2O2O, dated 25.08.2020 issued 5 s/(, J wP t 1143 2021 by the responi.ent No.3 and directed the respondent No'4 to resume tct,al land admeasuring to an extent of Ac'5'04 guntas situated. in Sy.No.208 at Itikya-la Village by initiating the Land Encroachment Act, 1905. in the instant case, the petitioners purchased the propertvr after obtaining lIr\LA conversion proceedings and layout permission isir;ued by the Competent Authority. Th,: respondent authorities failed to hLe any document sJrowing that notices were issued r-o the petitioners for cancellation of NALA con't'ersion proceedings ,;lated 25.08.2O2O and the responder:rt No.2 without folkt,,ving the procedure for cancellation ol'NALA conversion by treating the subject land as Govel nment \ lanb and directed the respondent No.4 to initiate r* ---"1'{ - ) 6 SK, J wP 11143_2021 proceedings under the Land Encroachment Act, 1905. The said action of the respondent No.2 is arbitrary and illegal on the ground that without following due procedure contemplated under the Telangana Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 and Rules made thereunder and issued impugned orders.

9. The Ruie Nos.S(iv) and 9 of the Telangana Agricultural Land (Conversion for Non-Agricultural Purposes) Rules, 2006, reads as follows: "Rule 5. Powers of Collector/ Revenue Divisional Offrcer / Mandal Revenue Officer:- (iv). The Collector may suo motu or an application can call for the record, scrutinize to satisfy himself before or after the orders passed and to modify or anull any order or proceeding passed by the Competent Authority after giving notices and hearing the affected party. Rule 9. Appeal:- Every appeal lies to the Collector against the orders of the Competent Authority within (60) days from the date of receipt of copy of the orders." 7 SK, J wP_t r,43_2021

10. It ciearly shows that the respondent No'2 took suo motu appea-l proceedings and passed impugnecl order without issuing any notices to the effected parties, which is contrary- t() the Rule 5(iv) of the Rules, 2006 and the same is liable to be set aside.
