Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue an order, Direction or Writ more particularly one in the nature of Wit of Mandamus, challenging the action of the Respondents herein in not taking any action on the petitioner's representation dated 11-3-2005 given requesting to conduct the investigation on the petitioner's complaint been registered as FIR No. 91/2003 dt 2-2-2003 with the 3rd respondent as per law, as illegal, arbitrary contrary to the provisions of Code of Criminal Procedure and consequently direct the 3rd Respondent to investigate into the complaint lodged by the petitioner and file charge sheet accordingly and pass such other orders or orders as the Hon'ble Court may deem fit and proper in the circumstances of the justice Counsel for the Petitioner: MR.P.PURUSHOTHAM REDDY Counsel for the Respondents: GP FOR HOME The Court at the stage of admission made the following
ORDER:
ORAL ORDER: The petitioner filed this writ petition challenging the action of the respondents in not taking any action on his representation dated 11.03.2005 and for a consequential direction to the third respondent to investigate into the complaint lodged by him and file charge sheet. The grievance of the petitioner is that though the complaint lodged by him was registered as F.I.R.No.91 of 2003 dated 02.02.2003 on the file of the third respondent- Station House Officer, Sanjeeva Reddy Nagar P.S., Hyderabad, no further action has been initiated so far. In view of the inordinate delay in initiating further proceedings, he made a representation on 11.03.2005, which also did not yield any result. In such serious matters, it is unfortunate to comment that the role of the Investigation Officers is not upto the expectations of the general public. In view of the above, suffice it to close the writ petition with a direction to the respondents to complete the investigation and take further steps with utmost expedition giving no room for any further criticism on this issue, preferably, within two weeks from the date of receipt of a copy of this order. The writ petition is accordingly closed at the admission stage.
