The brief facts of the case as stated are that the National Highways Authority of India (NHAI), established under the National Highways Authority of India Act, 19gg, deveiops, maintain, and manages Nationa_l Highways in the country. NHAI is.headed by a Chairman ald Members, with its head office in New Delhi and project Implementation 2 Units across the country' including the one at Gajwel' led the Project Director' Land acquisition procedures are governed bY the National Highways Act' 1956' with Sectrons 3-A to 3-G outlining the Powers for lan{ acquisition' survey, hearing of objections' declaration of insPection, determinatron' The acquisition, and comPensation petitioner' develoPing in line with the objectives of the NH Act' is a Greenfield Regional Expressway on the northern side of HYderabad' connecting GirmaPur Village 4g2+2OO\ in SangareddY District to NH-6s, Km NG-65, 66 $$+400) in Yadadri Bhuvanagiri District, covenng 158.645 km und'er the Bharatmala ChoutuPPal ( Pariyojana.

4. l,earned counsel for the petitioner would submit that the Government of India has appointed the CALA cum RDO, Bhongir, as the Competent Authority for land acquisition. Private lands affected by the highway widening are being acqrrired in accordance with Sections 3-A to 3-G of the National Highways Act' A notification under Section 3A of the NH Act (S.O. No. 3gg4 (E) dated 23'08'2022 and S.O.No.2852 (E), dated 30.06.2023\ was issued and I 1 I 3 published in the Gazette of India. pursuant to this, Respondent No.5 (CALA) requested permission from Respondents No.l to 3 for acquisition of Endowment lancls by a letter dated 30. 12.2024 (Lr No. Bt/Ttl/2022). 5. Eariier the Archaka Sarnakhya of Andhra. Pradesh hled W.P.No.10547 of 2006 before Division Bench of the then Andhra Pradesh' High Court against acquisition 1 4 ^ of endowment lands and Hon'ble Division Bench was pleased to grant interim order dated 30'05'2006 in W.P.M.P.No.132O4 of 2006 in W'P'No'10547 of 2006' relevant portion is extracted here under: "that there will be stag of all further pro"3"|i'g,t in relotion tZTn" iili'an o7ii" iinas"b"longi to the temptes atl ouer the state ot -norcue' Jigi ttog o'J dt-uiation on this regard iiaa a. treated' as contempt of aurt'" 6 Following the bifurcation of the High Court of the Andhra Pradesh Judicature at HYderabad under Reorganization Act, 2074' a separate High Court was established at Ama-ravathi for the State of Andhra Pradesh' Since the land acquisition in q'e"tiot' falls under the territorial jurisdiction of Andhra Pradesh' the W'P'No' 10547 of 2OO6 was transferred to the High Court at Amaravathi.

Learned counsel for the petitioner would submit thattheCollectorandDistrictMagistrate,Yadadri Bhuvanagiri-respondent No'4 addressed a letter to Revenue Divisional Officer (RDO), Bhongir dated 17'Ol'2O25 to request for permission for acquisition of Endowment Land to arr extent of Ac.6.32 gts(2.751a24 ha) in Sy'No'679 coming under alignment of Regional Ring Road (southern 5 Portion) in yadadri Bhuvanagiri District. The Commissioner (FAC), Endowment Department, Telangana, Hyderabad requested to file affidavit before the Hon,ble High Court seeking permission for acquisition of Endowment land to al extent of Ac 6.32 gts(2.757824 ha) in Sy.No.679 coming under alignment of Regional Ring Road (southern portion) in Yadadri Bhuvanagiri District. Thereafter, the RDO vide letter dated 22.O2.2025, informed the Project Director, NHAI, PIU-Gujwel to file an affidavit before the Hon,ble High Court for seelng permission to acquire endor,r.ment la,d coming under alignment. B. In view of the above back drop and facts ald circumstances of the case, this writ petition is filed seeking permission of this Court to acquire land admeasuring Acres 6.32 Gts in Sy.No.679, situated at Rargiri Village, Bhuvanagiri Maldal, yadadri Bhuvanagiri District of Endowment land.
