Counsel fof the Petitioner: SRI VEMULA SURESH Counsel for the Respondents: GP FOR REVENUE The Gourt made the following: ORDER a' ORDER: THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY 1VRIT PETITION No.875O of 2O2S This writ petition is filed seeking following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Honble Court may be pleased to issue aI.I appropriate Wiit, Order or Direction, more p4rticularly one in the nature of Writ of Mandamus, declaring the action of the Respondent Nos.3 to 5 in faiting to consider the Meeseva online Application of the Petitioner vide Transaction ID.No.240O002466, dt.O2.O3.2O24 for deletion of the petitioner's schedule Patta Property admeasuring AC.5.OO in Sy.No.540/ 152/2/ I situated at Peddaveedu Village, Mattampalli Mandal, Suryapet District from the prohibitory list as illegal, arbitrary, unconstitutional and contrary to the provisions of ROR act and consequently direct the Respondent Nos.2 to 4 to forthwith consider the Meeseva Online Application of the Petitioner vide Transaction ID. No.24000024 66, dt.O2.O3.2024 for deletion of the petitioner's above said property from the prohibitory list to enable the petitioner to alienate the same, and to pass such other order or orders as this Hont)le Court may deem fit ancl proper in the circumstances of the case."
2. It is stated that land admeasuring to an extent of Acs. 5.0O rn Survey No.540/ 152/2, situated at Peddaveedu Village, Mattampalli Mandal, Suryapet District (for short, 'the subject property) was assigned by the Government under Lavoni Rules in favour of one Mr. Vadapalli Ramaiah on
16.04.1977. It is further submitted that as per condition No.1, the assignee is free to alienate the land without any conditions irrespective of the fact whether they are assigned on collection of market value or free of market value. It is further stated that the said Ramaiah has executed unregistered document in favour of the petitioner and agreed to sell the said property and accordingly, the petitioner along with said Ramaiah approached the Sth respondent for regularization and accordingly, the 5ft respondent has 2 CVBR, J W.P.No.8750 of 2O25 regularized the document by collecting requisite stamp duty and registration fees arrd transferred the subject property in favour of the petitioner uide Proceedings No.Gl493/97 d.ated. 24.02.1997 and the name of the petitioner was entered in the 1-B Register and old passbook was issued to the petitioner under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 and as such, the petitioner is in possession and enjoyment of the subject property. It is further submitted that during the survey conducted by the Government of Telangana in the year 2O18, new digital passbook was issued to the petitioner on 14.05.2018 for the subject property by disclosing the status of the land as 'patta' and his name was also entered in Dharani Portal. It is further stated that while entering the land details in the Dharari Portal, the status of the subject property was mentioned as 'assigned' and when the petitioner approached the Sfi respondent, he was informed that ihe subject land is placed in the prohibitory list and unless the subject property is deleted from the prohibitory list, the petitioner may not be able to alienate the same. The grievance of the petitioner is that he has made an online applioation on O2.O3.2O24 in Dharani Portal for deletion of the subject property from the prohibitory list uide Transaction ID.No.24O0OO2466, but the same was not considered by the respondent authorities.
3. Considered the submissions made by the learned counsel for the parties and with their consent, this writ petition is disposed of at the admission stage. I 3 CVBR, J W.P.No.8750 of 2025
4. Prima facie, it appears from the record that there is no condition for non-alienation of the property assigned in favour of the vendor of the petitioner. Further, it is seen from the record that the revenue authorities have considered the sada bainama and validated the said sada bainama uide proceedings No.c/493197 dated 24.02.1997 and consequently issued old pattadar passbook to the petitioner. As the said document clinchingly proves that the land assigned is alienable, the respondents are not having any right to list the property in the prohibitory list.

Learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that under Sub-Section (4) of Section 22-A of the Registration Act, 19O8, any person aggrieved with the registration of the property as prohibited property is entitled to make an application for deletion of the said property from the list of prohibited t I properties.

In view of the above submissions and since it is stated that the petitioner has already made an application, dated 02.03.2024 uide application No.24OOOO2466 for deletion of the subject property from the list of prohibited properties, this Court deems it appropriate to dispose of this writ petition directing the respondents to examine the said application strictly in accordance with the provisions of the Registration Act, 1908, taking into consideration of the documents enclosed in support of the said application and the assignment patta certificate granted in favour of the 4 CVBR, J W.P.No.8750 of 2O25 a- vendor of the petitioner on 16.04.1977 and pass appropriate orders in accordance with law and communicate the same to petitioner within a period of eight (8) weeks lrom the date of receipt of a copy of this order. In any event if the petitioner is not entitled for deletion. of the properties, the respondents are directed to pass a reasoned order and communicate the reasons thereon to the petitioner.
