J 4 5 A 7 o o 1 Petition under Article 226 of the Constitution of lndia prayirrg that in the circumstances stated in the affidavit filed therewith, the High C'rurt may be pleased to issue.a Writ, Order or a direction, more particularly one in the nature of Writ of Nlandamus to declare the action of the Official respondents in not determining and recastrng the inter-se-seniority list of School Assistants posts relating to vacanc:ies of 2OO1-20O2 years which were required to be filled by a common requisition with regard to direct recruitment and promotions in the post of School Assiitants without adhering to the prescribed quota of 30% quota for direct recruitees and 70 Percent quota for promotees in respect of melhod of appointment of llchool Assistants in School Education Department as per applicable rules for the purpose of promotion to the post of Panel Grade Headmaster and its allied posls and keeping the settlement of dispute of inter- se-seniority between the direct recruits and promotees of the <;laims of the petitioners for more than two decades despite the district unit department recommended for notional seniority in terms of quota rules and ,,"" ^ ;"; ;; recommendation Lr.Rc. 2. Heard Mr. M.Bharat Shah, learned counsel for the petitioners and learned Government pleader for Education appearing for the respondents. perused the material available on record. 2 \\?_8653 2025 RRN, J

3. Learned counsel for the pelitioners submrtl;' that the petitioners rvere initially appointed as a Secondary Grrlde Teacher (SGTs) in the year 1996 and 1998. Subsequently they were promoted tc, the post of School Assistants (SAs) with effect from Ol.ll .2OO2. However, the promotion counseling, which was originally s,cheduled for 03.O9.2OO2, under the ratio 7O:30 prescribed quota rule in promotional post of Scho'.rl Assistant between the direct recruits and promotees, taking into consideration of DSC-2OO:2, which was postponed to 20.lO.2OO2 arld 2l.|O'2OO2 respectively, which affected the seniority of the petitioners lt is further subrnitted that the postponement of the counscling resulted in the direcl. recruits being benefited, thereby adversely affecting the promotions of the promotees to higher posts such as Panel Grade Headmaster. Learned counsel for the petitioner further suburits that the 4. petitioners have made representations on 10.O1 .2025 and 25.02.2025 to the Director of School Education requesting the revision of the seniorit5r list in accordance with their proinotion order dated O1.11.2002 and placing them above those appointed through District Selection Committee (DSC) on 17.lO.2OO2. Despite receiving the said representations, the respondent authorities did not act ,/ \ \ 3 wP_86s3 2025 RRN, J upon the same. Therefore, the present writ petition has been hled by the petitioners.

Learned counsel for the petitioners further submits that a similar issue was raised in W.P.No.627 of 2025 and the sarne was disposed of by this Court by order dated 13.02.2025 and the petitioners therein stands on similar footing. Therefore, appropriate \ orders be passed in this writ petition by directing the respondent authorities to consider the above representations submitted by the petitioners and pass appropriate orders in accordance with law.

On the other hand, learned Government Pleader for Education, appearing for the respondents submits that the respondents would consider the representations submitted by the pelitioners and pass appropriate orders thereon, in accordance with law. 7 . Having considered the submissions made by learned counsel for the petitioners, and without going into merits of the case, the respondent authorities are directed to consider the representations submitted by the petitioners on 10.01.2O25 and 25.O2.2025 and pass appropriate orders in accordance with law, within a period of six (06) weeks from the date of receipt of a copy of this order. 4 v,'P 8653 2025 RRN, J g.
