KUMARA SWAMY Counsel for Respondents: GP FOR REVENUE The Court made the following: ORDER THE TION'B LE SRI JUSTIC E C.V.BHASKAR REDDY WRIT PETITION No.8534 of 2025 ORDER: This writ petition is filed seeking following relief: "For the reasons stated above it is prayed that this Hontle Court may be pteased to issue a writ order or a direction, more particularly one ir.r naturc of Writ of Mandamus directing the oificial respondents to pass orders on the online grievance application filed in the Dharani Portal vide Mutation Application No.25O0002707 dated 29-01-2025 and mutate her name in the Revenue Records and issue patta passbook for the petitioner's agriculture land in Sy.No.1170/11 to an extent ol Ac.2-O2 gts, srtuated at Elgandal Village, Karimnagar Mandal, Karimnagar District, Telangana State, having purchased the same from the Original Pattadar Bondhyala Sreelampelli try rva,v of Sadabinama dated 10-05-2004 after giving notice to all interested , parties inctucting original pattadar (if alive) or to his legal heirs of the original pattadars and also dectaring the highhanded action of the respondents in not passing the order on grievance application mentioned above as arbitrary, un1ust and violalive ot Article 14, 2l arrd 300-4 of the Constitution of India and pass such order or orders as this Hon'bte Court may deem fit and proper in the circumstances of the case.'

It is stated that the petitioner is the owner and possessor of agricultural land admeasuring to an extent of Acs. 2.02 guntas in Survey No.117O/11, situated at Elgandal Village, Karimnagar Mandal, Karimnagar District (for short, 'the subject landJ, having purchased the same from the original pattadar Sri Bondhyala Sreelampelli under Sada Bainama dated
10.05.2004. It is further stated that under the said Sada Bainama, possession has been delivered to the petitioner and she is in enjoyment of the subject land. It is further stated that the name of the original pattadar is shown in the revenue records artd also in Dharani Portal. The grievance of the petitioner is that she has made an online application in Dharani Portal {E!iF|t 2 CVBR, J W.P.No.8534 of 2025 uide Mutation Application No.25OOOO27O7 dated 29 .O1.2025 seeking mutation of her nam,r in the revenue records and to isslre patta passbook in respect of the subjer-t land basing on the Sada Bainama dated 10.05.2004, but till date rhe ;a id apptication has not been considered by the respondents. 3. Considert:d the submissions made by the learned counsel for the parties and with thcir- r:onsent, this writ petition is clisposed of at the admission stage.

Learned Govcrnment Pleader for Revenue appearing for the respondents vehemr'.rtly contended that after repealing of the Telangana Rights in Land and f,attadar Passbooks Act, l97l and replacing the same with the Telangana liights in Land and Pattadar Passtrooks Act, 2020, no power is conferreC on the revenue authorities to erntertain any Sada Bainama/ordinary srrlc deed for regularization and consequential issuance of the pattadar passbook. LearneC Government Pleader further contended that in recently enacted ')'clangana Bhu Bharati (Record of Rrghts in Land) Act, 2025, there is er pro'r' sion for regularizaticn cf the Sada Bainamas. Learned Government Pleader further contended that the said Act has not been notihed by gir,,ing enlbrccmeni, Cate and as soon as the said Act is notified, the petitioner is enlitlecl r-o make an apr,iication to the respondents for mutation of the sublcct land ir-r her name and for consequential issuance of patta passbook and il the petitioner complies with all the requirements J CVBR, J W.P.No.8534 of 2025 under the provisions of the Telangana Bhu Bharati (Record of Rights rn Land) Act, 2025, the same would be considered in accordance with law'

In view of the above said submissions' the Writ Petition ls disposed of leaving it open to the petitioner to make an appropriate application to the respondents for mutation 'of the subject land in her name and for consequential issuance of patta passbook as and when the Telangana Bhu Bharati (Record of Rights in Land) Act' 2025 comes into force and if the petitioner complies with all the requirements under the'provisions of the said Act, the respondents shall consider the same in accordance with law.
