THE HON'BLE SHRI JUSTICE ANIL KUMAR JUKANTI WRIT PETITION No. 999l of 2O2L ORDER: W.P.No.9991 of 2O2l is filed seeking the following relief: "...to issue an appropriate writ, order or direction, more particularly in tf-re nature of Writ of Mandamus declaring the action of the Respondent No.4 in not receiving and register the sale deed dated 12.O3.2021 prescnted by the Petitioner/Vendee in respect of the Open Plot No_2666 in of Shankar Hills Colony, admeasuring 500 Square yards of 418 Square meters, forming a part of the sanctioned Layout Plan of Survey Nos.111,134 to t39, 146lAl l, l4B to 158, 159/A, 16I, t62, 165, t66, 17L, 178 ro 180, 181/A, 183, 189 to 191, situared ar Vattinagulapally Village and G.P., Gandipet Mandal, Ranga Reddy District, Telangana State, and declare the same as illegal, arbitrary, without application of mind and contrary to the provisions of Stamps alld Registration Act and without jurisdiction as well as the r,,rolation of the fundamental rights guaranteed undcr the Constitution of India and consequently dircct lhe rcspondent No.4 to receive and register the Petitioner's sale deed dated 12.03.2021 in favour of the petitioner for the above said plot/land and pass such other or further orders..."

12.03.2021 presented by petitioner in respe<:r of open plot No.2666 of Shankar Hills Colony, rdmeasuring 500 sq. yards, forming a part of layout p [i .n of Survey Nos. 111, 134 to 139, 146/A/1, 148 to 158, 159/A, 161, 162, 165, 166, 17 l, 178 to 180, 181/4, 18ll 189 to 191, situated at Vattinagulapally Village and C.r., Gandipet Mandal.

5. It is averred in the writ a-fhdavit tl at petitroner presented the sale deed dated 12.03.2021 i r thc olflce of respondent No.4 and that he paid arr arnounL of Rs.2, 13,100/- towards registration fees ald i amp duty by way of e-challal on 08.04.202 1.

6. Grievance of petitioner is that in sp -e of paying registration fees and stamp duty, the salc deed is not received ald registered, for reasons bes - knorn,n to respondent No.4. On the other hald, learned Assistant Government Pleader for Stamps and Registration appearing for respondents placed on record a counter affidavit signed by the Sub-Registrar, Serilingampally Village. It is stated in the counter affidavit that the said survey numbers, wherein the open plot of petitioner is situated, are not prohibited for registration, It is further stated that sale deed was not presented by petitioner in the office of Sub-Registrar. B. Heard learned Assistant Government pleader appearing for respondents and perused the record. 9 . It is averred in the writ affidavit that petitioner is seeking registration of land admeasuring 5OO sq. yards i.e. open plot No.2666 of Shankar Hills at Vattinagulapally Village, Gandipet Mandal, in Survey Nos.1l1, 134 to 139, t46/A/ 1, 148 to 158, 159/A, 16r,162,165, 166, tZt, r7a to 180, l8I/A, 183, 189 to 191. That petitioner presented sale deed dated 12.03.2021 in the office of respondent No.4 by paying registration fees and stamp duty vide challan No.446UQF08O42 1 dated 08.O4.2O2t. 4 JAK,J W.P.No-9991 2021

On a perusal of the counter affidavit ; gned by the Sub-Registrar, Serilingampally, it is evident t hat the said survey numbers i.e., survey Nos.1 11, 134 to I: '9, 146 lA/1, 148 to 158, 159/A, t6t,t62, 165, 166, 171, I7B to 180, 181/A, 183, 189 to 191, in which the land rdmeasuring 500 sq. yards belonging to petitioner is sit r ated, is not prohibited for registration, but it is alsc stated that petitioner did not present any document 1 1 . Be that as it may, as it is apparent t rat the said survey numbers are not prohibited for regir; ration, open plot bearing No.2666 of Shankar Hills Colony rdmeasuring 500 sq. J,ards, situated at Vattinagulap illy Viilage, Gandipe t Mandal, belonging to petitioner is entitled for registration. Respondent No.4 shall nol object the registration, as it is stated in the counter aff < avit that thc said survey numbers are not prohibited for re6 .stration.

12. Petitioner is at liberty to present the sal: deed before responder-rt No.4 for registration. Upon preser ting the said sale deed, respondent No.4 sha1l receive anc register the sale deed. It is made clpar that if at all, -here is anv I 5 JAK,J W,P.No.999 t 2021 objection for such registration, Sub-Registrar shall indicate the reason for not receiving the document for registration.
