This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri C HARI PREETH, Advocate for the Petitioner and Sri Jithender Rao Veeramalla, the Addi. Public Prosecutor on behalf of the Respondent No.1 and none appeared for the Respondent No.2. The Court made the following: ORDER l I THE HONOURABLE SRIJUSTICE N. TUKARAMJI CRIMINAL PETITION No.3814 of 2025 ORDER: This petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashment of all further proceedings in FIR No.71 of 2025 on the file of Saroornagar WPS Police Station, Rachakonda Commissionerate, against the petitioners/accused Nos.2 and 3.
2. Heard Mr.C.Hari Preeth, learned counsel for petitioners and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State and M.Rajender Reddy, learned counsel for respondent No.2.
The petitioners are arrayed as accused Nos.2 and 3 in FIR No.71 of 2025 tor the accusation under Sections 498-A, 406, 42O and 506 of lndian Penal Code,1860 and Sections 3 and 4 of Dowry I I I I Prohibition Act.
Learned counsel for the petitioners would submit that though the petitioners are willing to participate in the proceedings and though the I I police concerned has issued notice under Section 35 (3) of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS,2023') the petitioners are apprehending coercive measures against them. He . further submits that as the petitioners are ready to cooperate with the 2 investigation as such, prayed for direction to the investingating agency to follow the guidelines issued by the Hon'ble Supreme Court in Arnesh Kumar v. Sfafe of Biha/.
Learned Additional Public Prosecutor submits that there is no impediment to the Police concerned in abiding the guidelines of Arnesh Kumar (supra). However prayed for direction to the petitioner to cooperate in the investigation. I have perused the materials on record.
Having regard to the submissions of learned counsel and considering their readiness to participate in the proceedings, the investigating officer is directed to proceed with the investigation as per the principles laid down in Arnesh Kumar (supra). ln unison, the petitioners shall cooperate with the process of investigation
