Operative part
The charge sheet filed against the petitioners/A1 to A3, clearly discloses that the petitioners obstructed and assaulted L.W.2-Sanitary Inspector, who was entrusted with the work of removal of encroachments on the northern side of D.N.Road, and also L.Ws.3 to 8-Sweepers, who are entrusted with the work of cleaning the garbage. The police after due investigation into the complaint and recording the detailed statements of L.Ws.1 to 11, under Section 161 of the Code of Criminal Procedure, 1973, the charge sheet against petitioners/A1 to A3 for the offences punishable under Section 353 r/w 34 of the Indian Penal Code, 1860. Therefore, the prosecution should be given an opportunity to prove the accusation made against the petitioners/A1 to A3. It is not a case where the proceedings have to be quashed without giving an opportunity to the prosecution.
