S.C. No.225 of 2023, on the file of the Special Judge for Trial of Cases Under SCs/STs (POA) Act, 1989- cum-lll Additional District & Sessions Judge, Karimnagar, against the petitioner

2. The petitioner is arrayed as accused No.B in the Special Sessions Case registered for the offences punishable under Sections 294(b),324, 427 read with Section 34 of the lndian Penal Code, 1860 and Sections 3(1XrXs), 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention Of Atrocities) Amendment Act, 2015.

3. Heard tVlr.B.Vikram, learned counsel for the petitioner, Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor; representing the respondent No.1-State and [\tls.Vanaparthi Vaishali, learned counsel for the respondent No.2l de-facto complainant

Pending this petition, the parties have entered into the compromise and, accordingly, respondent No.2/de-facfo complainant filed l.A.Nos.1 I b- . and Z of 2025 with the prayer to permit them to enter into compromise 2 NIRJ r.-,/..\,.r. / drd 2 ol'2025 ir/and {.r, P i\0.1t92 oJ 2025 and by record ng lhe settlement to quash the proceedings against the petitioner/accu sed in Spl.S.C.No.225 of 2023

5. This Cotrrt '/ide order daled 17.03.2025 refered the parties to the High Court Ler;al {iervices Committee for identification and to verify the voluntariness irr ar'rivrng the settlement. The Secretary, High Court Legal Services Comrnittee, has submitted report dated 21 .03.2025 stating that the parties wr:re identified by their respective counsel and also on i verification of Aadhar Cards/ldentity Cards and the enquirir>s revealed that the partres have willfully and without coercion e.rtered into settlemenUcon prornise

The accrrsations against the petitioner/accused No.B irr the Police Report are thzrt, the petitioner/accused No.8 and other ac<;used were attacked on th,-, respondent No.2/de-facfo complainant and rtthers, who belong to SC Comrrunity, and beat them with sticks, hands and stones by abusing them on their caste and they also damaged a nrotor cycle. Having considered the allegations, the nature of charged offences and - taking into accrunl the amicable settlement between the parlies, in the ) NT&/ I-4.N0t.1 and 2 0J 2025 in/and Cn|.PN03792 o-f 2025 light of the dictums in Gian Singh v. State of Punjab and anotherl and Anit Mishra v. State of u.P.2i State of Madhya Pradesh v. Laxmi Narayan and others3, this Court is of the considered view that quashment of the impugned proceedings in view of the settlement by exercising jurisdiction under Section 482 Cr.P.C.1528 of BNSS, 2023, would be in the interest of justice.

8. Accordingly, l.A.Nos.1 and 2 o'f 2025 are allowed. Consequently, r' all the proceedings in Spl.S.C No.225 of 2023, pending on the file of the learned Special Judge for Trial of Cases under SCs/STs (POA) Act, 1989-cum-lll Additional District & Sessions Judge, Karimnagar, are hereby quashed against the petitioner/accused No.8
