15.07.2C2I of the petitioners.

2. Heard learned counsel for the petitioners, learned Government Pleader for Revenue, appearing on beha-lf of respondents 1 to 4. Perused the record.

Learned counsel for the petitioners submits that the grandfather of the petitioners w'as the original. owner and I pattadar of the land admeasuring Ac.0.34 gts in Sy.No.286 and Ac.2.l7 gts 1n Sy.No.287, situated at Koppole Village of Gurrampodu Mandal, Nalgonda District. The Khasra Pahani of the year 1954-55 also shows that their grandfather was the pattadar, owner and possessor. From their grandfather, the father of the petitioners succeeded the said property. Thereafter, the petitioners herein have succeeded the said property ald 2 accordingly, the Tahsildar, Gurrampodu Mandal issued succession proceedings in the year, 2O18 in respect ,rf the land. admeasuring Ac.O.O45O gts in Sy.No.286l8l1 arrd Ac.0.2950 gts in Sy.No.287 l3l2 and accordingly the saic propertv was mutated in the narnes of the petitioners hereir in the revenue records and issued new title deeds and pattitdar passbooks. While so, the petitioners carne to know that in :he name of one Shaik Bismillah-Stt' respondent, arr entry was made in the Dharani portal showing her as pattadar of the land admeasuring Ac.0.0499 gts in Sy.No.286/2 and Ac.0.2O gts in Sy.No.287 /3 situated at. Koppole village, Gurrampodu Mz:rdal, Nalgonda District and also she has obtajned title .boo k and pattadar passbook. Basing on the same, the 5th responlent is trying to interfere with the possession of the petitioners. Algrieved by the sarne, the petitioners herein approachetl Tzrhsildar-4th respondent, Gurrampodu and have submitted al application under Right to Information Act, requesting to fulnish documents and proceedings relating to the propert5r in qut:stion. But, the 4th respondent did not respond to the s ild application. Immediately, petitioners have approached Revenue Divisional Officer-3,d respondent, Devarakonda by hling an Appeal, who inturn passed orders dated 04.ll.2Ol9 di :ecting the 4th 4 3 respondent to furnish the information sought b1' the petitioners. Despite passing of said orders, no information was provided by the 4th respondent to the petitioners.

Learned counsel for the petitioners further submits that basing upon the fabricated documents, the name of the srh respondent is entered in the revenue records ald pattadar passbook bearing No.T2810C28O0 19 was issued. Aggrieved by the same, the petitioners filed a representation dated L5.O7 .2021 before the 2"d respondent seeking to conduct detailed enquiry into the matter. However, learned counsel submits that vide letter dated 15.09.2021, the 4tn respondent had repiied stating that information sought by the petitioners was furnished to them through Public Information Officer & Nayab Tahsildar vide letter dated 27.08.2021 arld file relating to information sought by the petitioners is not available in the office. In the absence of any record, the interest of the petitioners would be defeated; therefore, petitioners are seeking a direction to respondents to conduct detailed enquiry pertaining to the property in question.

5. Learned Assistant Government Pleader for Revenue submits that though the information sought by the petitioners I I has aJready been furnished to them, they have approached this 4 -r Court. He further submits that the relief sought lrv the petitioners is r-rot pending on the hle of tlre respondents. Hor','ever, he seeks an appropriate direction to 4 th respon<lent to conduct enquin' in the matter by putting the 5,h respondent on notlce

Having regard to the rival contentions rrf the both the parties ancl $,ithout making any observations on merirs and demerits ol' the case, the official respondents are directed to conduct delailed enquiry in respect of the property in question by putting the 5th respondent on notice and also alTording an opportunity of personal hearing to her and lhereafter, pass appropriate orders in accordance with law, as r.xpeditiously, as pos sib le 7 .
