BHASKAR REDDY ORDER: WRIT PETITION No.789 I of2o25 It is stated that the petitioner is the owner and possessor of the agriculture land admeasuring Ac.l.2O guntas in Sy.No.27 17 / 2, situated at Sardapur Village, Siricilla Mandal, Rajanna-Siricilla District, having purchased the same through sadabainama, dated 06.02.2073. It is further stated that the name of the petitioner was mutated in the revenue records uide Proc.No.B/82 l/2017, dated 24.12.2O17 and pattadar passbook No.S-584149 was issued in his favour under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 197 I (for.short'the ROR Act, 197l"l and the Rules made thereunder. It is further stated that e-pattadar passbook No.T1908OO10234 was also issued in favour of the petitioner under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O (for short "the Act 9 of 2O2O1. It is further stated that since the date of purchase, the petitioner has been enjoying the absolute rights and also receiving various incentives sanctioned by the Government from time to time as investment subsidies for cultivation of the said land. It is further stated that the respondent authorities, without issuing any notice and without condrEti;g any enquiry, have notified the subject property in 2 CVBR, J v{p 7'i9t 2025 the list rf Frohibited Properties and therefore, hr: :nade a representatiolrs, dated 18.O1.2025 and 30.O1.2(125 seel<ing for deletion ,rf thc subject property from the list of prohibited propertiesi. 'l'he grievance of the petitioner is that ev(:rn after receipt o1- thr, said representations, the respondents ,lid not consider the same.

4. Sri L.Ravinder, learned Assistant Government pleader for Revenue, has vehemently contended that the petitioner had purchased the subject property from the political sufferer/ freedom hghter and as such the subject property is notified in the list of prohibited properties.

At this stage, learned counsel for the petitioner has submitted that as per G.O.Ms.No.\717, Revenue (Assignment-l) Department, dated 1 1.1 1.1993, the Government has directed the Commissioner of Land Revenue, to permit the trx- Servicemen to sell away the assigned lands after l0 years from the date of the assignment ,
6. The above issues are required to be examined by passing a reasoned order. Further, sub-section (4) of Section 22-A of the Registration Act, 1908 confers the power on the State Government either suo motu or on an application by any person or for giving effect to the final orders of the High Court of \ \ Telangana or Supreme Court of India to proceed, to de-notify, either in full or in part, the notification issued under sub- Section (2) and the Rules made under the provisions of the Act.
7. In the instant case, since it is the specific case of the petitioner that he had already made applications, dated t , 4 CVBR, J wp "'891,-2o25 n.
18.O7.2Ct25 and 30.01.2025 requesting the reripondent authoritjes .o delete the subject property from th:r list of prohibiterd properties, this Court deems it apprcpriatc to dispose of the rr rit pctition directing respondent No.2 to e;<ar nine the said application strictly in accordance with the provis;io,es of the Registral.ion Act, 1908. While doing so, respondent Nrr.2 shall take into consideration the pattadar passbook issued :n favour of the pe:titioner and determine whether the subject pr,rperty is rightlf inclurlcd in the list of prohibited properties or not and thereafte r, he shall pass appropriate orderrs tl-re : eon, in aicorclance rvith lavr,, within a period of two (02) mon:hs from the date of r,:,:eipt of a copy of this order and communicate the same to the pctitioner.
