3. Vide thr: irnpugned order, the trial court has rejected I petition filed by the peti,.ioner/defendant No.6 under Section 45A of t he Indian Ei.'idence ;\ct ard Section 79-A of the Information and Technology Act read with lit:t:tion I 5 I of Code of Civil procedure 1 909.

Thc petitioner/defendant No.6 through the said petition requested the trail court to send the pen camera to the Forensic Scie.ce Laborat.rl. to know the genuineness of the and the 'idec contents of tl-u: pen calnera to be real one or not. It is this petition which has beer r.ejected by the trial court. t I 2 Y\

5. It has been found during the course of deliberation that the recording ofthe private conversation by the petitioner/defendant No.6 was not with the knowledge of the parties but was lrom hidden camera.

6. The reading of the findings given by the trial courr while rejecting the said petition itself would go to show that the manner ol recording carried out by the petitioner through hidden camera which in the mind of the court was not permissible under the provisions of Indian Evidence Act. 7 This Court does not find any illegatity or perversity in the order so passed by the trial court and therefore, the impugncd order does not waffant any interference. 8. Considering the fact that the suit is more than 20 years old, let the suit be taken up on a priority basis and the trial courl is expected to decide the same as expeditiously as possible.
