4. For the sake of convenience' W'P'No'7357 of 2025 is taken up as leading case to decide the lis in these cases' 5. Considered the submissions of the learned counsel for the respective parties and perused the record'

6. lt is stated that the pelitioner is the pattadar and possessor of the agricultural iand to an extent of Ac'O 16 gts' ' in Sy'No' 1 16' situated at Sunkenapally Viilage' Chityala Mandal' Nalgonda District' It is further stated that originally' his father was the pattadar of the land to an extent ofAc lO'14 gts'' in Sy No'115' 116' 161' 2O7 ' 2O8 & 210, situated at Sunkenapaily Village and his name is recorded in the revenue records and pattadar passbook has also been issued' It is further stated that after the death of his father' the petitioner and his brothers divided the said land into three parts and the petitioner has got land to an extent of Ac'1 01 gts ' and his name is recorded in the revenue records and pattadar passbook has aiso been issued in his favour under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act' 1971 It is further stated that out of the said land, the petitioner has sold some of the iand' except the land to an extent of Ac.O' 16 gts; and thus he made an online application dated Oa.o3.2O23 seeking to issue e-pattadar passbook in respect of the land to an extent of Ac.o.16 gts. L t held that if there is any disputr: witl r:gard to I approach existence of the road/ pathway and neighbouring oluners disputed very existence of road/made encroachments on road' if easementary rights are affected in any manner, the aggrieved parties have to the competent Civil Court seeking appropriate relief' A the impugned order dated 16 Og '2023 passed by perusal of respondent No.2 would reveal that after examining all the relevant records, respondent No'2 has rightiy advised the petitioner to seek redressal of his grievance before the competent Civil Court- Therefore' this Court does not find any legal infirmities in the impugned order this Court under Article 226 of Lh..e warranting interference of Constitution of India' g. Accordingly, both the Writ Petitions are clismissed relegating the petitioners to approach the competent Civil Court and seek redressal of their grievance, by hling a comprehensive civil suit' in accordance with law. On hling such suit' the Civil Court shall decide the same independently basing on the material placed on rccord' without being influenced by any of the observations made in thc impugned ordcr or in this order As a sequel, miscellareous applications pending if any' shal1 stand closed.
