VINOD KUMAR W.P.No. 7281 of 2025 ORDER: t{eard lezrrned Counsel for the petitioner, learned Government Pleader for Home appearing for respondents No. 1 to 4, and with the consent of the learned counsel appearing for the respective parties, the writ petition is taken up for hearing and disposal at admission stage.
2. l{aving regard to lhe nature of lis involved in the Writ Petition ancl the manner ol disposal, this Court is of the view that notice to unofficial respondent Nos.5 to 8 is not necessary for adjudication of the present Writ Petition.
3. The case ol the petitioner, in brief, is that the respondents- authoritics, particr-r1arly, respondent Nos.2 to 4 have not taken any action against respondent Nos.S to 8, who have illegally kidnapped thc petitioner, de tained in Narsampet Police Station, Warangal District on O8.01.2O25 & O9.O 1.2O25, subjected him to third degree treatment inhumanly, obtained his signatures on non- juclicial stamp papers, and also having taken cheque bearing No.OOO474, apart from getting his signature on promissory note and taking his iPhone 15 Promax, and threatening to implicate in I 2 contended false criminal case, n hich action of the respondents it is is in violation of Article 21 ol the Constitution of India. 4. This Court, on 1O.03.2025, while ordering ,notice admission, had directed the rcspondents_au thorities to place before this Court CCTV footage of the 4rn responden t_police station from 07.O 1.2025 to 72.01.2025. before
5. Pursuant to the aforesaid direction of this Court, learned Government pleader appearing on behalf of official respondents has placed before this Court in a sealed box statecl to contain a pen drive having CCTV footage of the 4d, respondent from O2.O1.2O25 to 72.O7.2025.

By placing the CCTV footage, learned Government pleader would submit that a case of ,missing woman and child, rvas registered against the petitioner on the file of Narsampet police Station of Warangal Commissionerate uide Cr.No.S16/2024, dt.25.12.2O2q; and that during the course of investigatiou into the aforesaid crime registered, the authorities have found the missing woman and child in the custody of the petitioner. 7 the respondents*authorities Learned Government pleader for Home further submits that finding the missing woman and child in the custody of the petitioner, have calred the petitioner to a r'a l I l l i I I I I 3 the police station for enquiry on O8 O1'2025 and O9'O1'2025' and on the said dates, the petitioner had approached the respondents- authorities with his friends. As regards the allegation of the petitioner being illegally detained and being subjected to third degree treatment on 08.O1.2025 and 09.Oi.2025 is concerned, a perusal of the CCTV footage as placed on record of this Court by the learned Government pleader for Home would show the petitioner coming to the police station with his friends and also walking out of the police station without there being any evidence/ indication of he having been subjected to third dcgree treatment. 1 1. Further, it is also to be noted that the petitioner, alleging he being subjected to i11ega1 detention and third degree treatment on
08.01.2025 and 09.01.2025, had hled the present Writ Petition after lapse of two months. It could be for the reason that the petitioner expecting that the respondents-authorities would not produce the CCTV footage of the said dates, as is usually claimed { 4 by-thern of the CCTV storage capacity not holding footage for longer period, had filed the present Writ petition only to prevent the authorities from taking further action in Cr.No.516/1O13, dt.25.12.2024, registered against him

Since, the CCTV footage as placed before this Court did not show the petitioner either being illegally detained or even subjected to third degree treatment as claimed by the petitioner, this Cour[ is of the view lhat the aforesaid allegations are only invented for lhe purpose of diverting the respondents-authorities from invcstigatrng into the aforc.said crime registered against him. 1 3. Furthe r, as it is now informed to this Court by the learne d Government Pleader for Home of the aforesaid crime registered against the petitioner having becn closed .as action dropped,, this Court is of the view that responden ts-authorities zrre to be direciecl not to interfere with the personal life and liberty ol the peLitioner, except in accordance with law.
14. The sealed envelope having external clisk containing CCTV footage is returned to the Registrar (Judicial II) to be preserved as per the procedure adopted for maintaining the records.
