Ms No 124, dated 301812018, the 2nd Respondent dlslocated the petitioner from the existing place of workin,; Zone to other zone allocation is illegal, arbitrary, and violative of principles of rratural justice without following the mandatory provisions of Article 368 of the Corstitution of lndia and the 2nd Respondent without having any Jurisdiction or Powt:r as per the G.O. Ms. No. 124, dated 30-08-2018, (2) Also that the 2nd Respondent dislocated the petitioners Zone and allocated him to other Zone on 23-OB-i'O24 and much earlier to that the 2nd Respondent issued revised Transfer Guidelines vtde Proceedings in Rc No GnGl120412024-1 , Oated 13-07-2024, which was not communicated to the petitioner, with instructions to the petitioner to report to the Respondent no. 4 immediately, as illegal, arbitrary, unjust, and procedura ly and substantively ultravires and the same is violative of fundamental rights guaranteed under Articles 14, 16 and 2'1 of the Constitution of lndia and consequently direct the 2nd Respondent not to transfer the petitioner and continue the services of the petitioner at the present place of posting, (3) to DIRECT the 2nd respondent to consider the representation submitted by the petitioner, datel 31-O1-2025. lA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the proceedings bearing Rc. Ms.No.317, General Administration (SPF-I) Department, dated 06.12.2021 and proposing to transfer the petitioner to other Zone though the petitioner had been appointed on 16.09.2023 and not completed even one year of service, is entitled to work at present place of work for 8 years as per the Transfer Guidelines issued by the 2"d respondent in Rc.No:G ITG/0731 /2024, dated 06 .O7 .2024, of criteria of the compulsory transfer as per rule 6(b) u,ho have completed B years of service and in violation of Rule 3 of G.O.Ms.No.124, dated 30.08.20 18, the 2"d respondent dislocated the petitioner from the existing place of working Zone to other zone allocation as illegal

2. Heard Krishnaveni Valavala, learned counsel for the petitioner, learned Government Pleader for Services-Ill appearing for respondent No. I and Sri Bhanothu Hussain, learned Standing counsel for respondents No.2 to 4. 2

Learned counsel for the petitioner subrnits that 2"a respondent dislocated the petitioner's Zone and allocated him to other Zone on 23.08.2024 and much earlier to that the 2".i respondent issued revised Transfer Guidelines r icle proceedings in Rc. No.G/TG/ l2O4 12024-1 , dated 13.O7.2(t24, which was not communicated to the petitioner; with instructions to the petitioner to report to the respondent No.4 immediately.

Learned counsel for the petitioner furthe r submits that the petitioner was ongoing medical conditions and his wife is working at Armoor, as such, the petitioner could not report and join the services immediately and made several -epresentations to 2"d respondent, but the sarne were not considered. He further submits that the petitioner recently submitted a representation on | 1 .O1.2025 to the 2"d resptrndent, and I prayed this Court to direct the authorities tr, consider the representation submitted by the petitioner on ll.Ol.2O2S.

5. Learned counsel for the respondents also rlicl not oppose for disposal of the petitioner's representation dated 11.O4.2025 in accordance with law

6. Having regard to the submissions made bl, the learned counsel for respective parties, this Court, with()ut expressing J any opinion on the merits of the case, direct the respondent authorities to consider the petitioner's representation, dated

11.04.2025, which was sent through Speed Post, and pass appropriate orders, in accordance with law, within a period ol six (06) weeks from the date of receipt of a copy of this order.
