BHASKAR REDDY WRIT PETITION No.6752 of 2o25 ORDER This Writ Petition is hled praying this Court to declare the action of the respondents in interfering with the peaceful possession of the petitioner over plot No.1 admeasuring 454 square yards, situated in Sy.Nos.139, 143 and 744 of Medchal Village, Medchal-Malkajgiri District, as illegal, arbitrary, unjust and in violation of the principles of natural justice and consequentially prayed for other appropriate reliefs.

It is the case of the petitioner that she is the owner and possessor of plot bearing No. 1 admeasuring 454 square yards, situated in Sy.Nos. 139, 143 and 144 of Medchal Village, Medchal-Malkajgiri District, having purchased the same through registered sale deed bearing document No.3133 of 2O10, dated 08.10.2010. It is further case of the petitioner that the said property was regularized by the respondent No.S and proceedings dated 28.08.2023 were also issued approving the layout. The grievance of the petitioner is that disputing her right and entitlement over the subject property, the respondents are frequently interfering with her possession and enjoyment over the subject property, without following due process of law. ) C\tsR, J Wp 6752 2025 ::. ,L

Cor-rsidered the submissions of Sri Ravi Mohan, learned Senior Corrnsel representing learned counsel for the petitioner; learned l\ss;istant Government pleader for Revenue appearing for respon,lsnt Nos. 1 to 4; Smt.D.Madhavi, learnecl Standing Counsel fr rl HMDA appearing for respondent No. i ; and Sri N.Sridhar I?eddy, learned Standing Counsel for TGSpDCL appearing lor respondent Nos.6 and 7 and with their consent, this writ petition is being disposed of at the admission stage.
4. Learrtr:d counsel for the petitioner submitted that the subject matr-er of this writ petition is squarel5, cover:d by the order pass,:,l by this Court in W.p.No.5274 of 2tr25 dated 21.O2.2O25 and prayed to grant similar relief to the per.itioner as

In terms of the afore .stated order and for the reasons mentioned therein, this Court, without expressing any opinion with regard to the right and entitlement of the petitioner over the subject property, deems it appropriate to dispose of this writ petition directing the respondents not to interfere with the possession of the petitioner in respect of plot bearing No.1 admeasuring 454 square yards in Sy.Nos.139, 143 and I44 situated at Medchal Village, Medchal-Malkajgiri District; without following due process of law. 8 With the above observations, this Writ petition is disposed of. It is the case of the petitioner that she is the owner and possessor of plot bearing No.13 admeasuring 3O7 square yards in Sy.Nos. 139, 144 arrd 143 situated at Medchal Village, Kistapur Road, Medchal-Malkajgiri District, having purchased the same through registered sale deed bearing document No.1599 of 2024, dated O7.O2.2O24. It is further case of the petitioner that said properfy was regularized by the respondent No.S and proceedings dated 10.04.2016 were a_lso issued approving the layout. 4. Sri L.R.avinder, learned Assistalt Government PleaCer for Revenue appearing for the respondent Nos.1 to 4 has sut,mitted that in pursu€r.rrce of the Proceedings No.LC/ 2277 12024 d,ated,
05.11.2024 issrued by the respondent No.2, the lr{anda-l Girdawar arr<[ Mandal Surveyor, Medchal Mandal, have demarcated the Government land admeasuring 5O0 Sq.yr,rds in Sy.No. 145 situated at Medchal Village and Mandal, for handing over advance possession to the Assistant Divisional trrrgineer Operation, TGSPDCL, Medchal Sub-Station, for the purpose of 33 / 17 KV llub-Station. It is further submitted that the petitioner, unclr:r the guise of alleged documents relal ing to : i 3 CVB& J Wp_5274 2025 neighbouring survey number, is trying to encroach upon the Government land. It is further submitted that the respondent No.4 is not interfering with the possession of the petitioner in respect of lald admeasuring 3O7 Sq yards situated at Sy.Nos.139, 143 and 144 situated at Medchal Village and Mardal, Medchal-Malkaj giri District.

In view of the above, this Court, without expressing any opinion with regard to the right and entitlement of the petitioner over the subject property, deems it appropriate to dispose of this writ petition directing the respondents not to interfere with the possession of the petitioner in respect of land admeasuring 307 Square Yards situated at Sy.Nos.139, 143 and 144 situated at Medchal Village and Mandal, Medchat-Malkqjgiri District, without following due process of law.
6. With the above observations, this Writ petition is disposed of There shall be no order as to costs.
7. As a sequel, the miscellaleous petitions pending, if any, sha.ll stand closed.
