2. Heard Sri S.Chandra Sekhar, learned counsel for the petitioners.a,Dd learned Assistant Govelnment Pleader for Larld \ \ I 2 Acquisitior. appearing for respondents.
3. Learned counsel for the petitioners submit that the subject lanrjs were assigned in favour of the petitioners 5O years back ald slnce then, they were in possession and r:njoyment of the subject talds and the revenue authorities herve mutated their names in the revenue records and issued pattadar passbooks and title deeds. He further submits that respondent No.1 has talren possession of the subject lands for the purpose of construction of Sathna_la project Irrigation Canal. Accordingly, respondent No.1 passed the arvard vide proceedings lvo.B/1318/1996, dated 30.06.199g ancl paid only ex-gratia. He frrrther submits that as per the principle laid down by the larger Bench of erstwhile High Court of Andhra pradesh at Hyderaba,l in Land Acquisition Offi.cer_cum-Reaenue Diuisionq.t efficer a, Mekala pandul, the petitir:ners are entitled for compensation on par with patta holders; and the action of respondents is contrary to the principle laidl down in Mekalc. pandu, s case (supra).

Learned Assistant t 2004 (2) ALD 546 Government pleader for Land i /i /t 3 Acquisition has not disputed the principle laid down in Mekala Pandu's case /suPra). 5, Taking into consideration the facts and circumstances of the case and submissions made by the respective parties' this Court deems it appropriate to dispose of the writ petition, with a direction to respondents to pay the compensation to the petitioners, as per the principle laid down in Mekala Pandu's ccse (supra) and as per the provisions of the Land Acquisition Act, 1894, within a period of three (3) months from the date of receipt of a coPY of this order. 6 With the above direction, the writ petition is disposed of No costs.
