2. The case of the petitioners, in brief is that the petitioners were initially appointed as Secondary Grade Teachers (S'G' Teachers) through selections. They were later called for counseling for the post of School Assistants from 27 'lO'2005 to However, their promotion orders were delayed due to 05.11.2005. pending caste certificate verifications and certain court cases' While other and DSC 2003 direct recruits, promotion to candidates, including LFL Headmasters were Promoted in November 2005' promotion orders only on 03'03'2006' the petitioners were g ra nted SubsequentlY, they joined the posts of School Assistants' 3 The petitioners contend that they are entitled to seniority on par with those who joined earlier, as their delay was due to court orders' They rely on the decision in O'A'No '675/20L6' dated 23'O2'2016' where the learned Tribunal granted notional promotion to similarly situated persons from the date of counseling' i'e'' on 28'10'2005' which was l A i uph eld by this Hon'ble Court in W.p.No.36466/2017. Aggrieved by the same, the petitioners have filed the present writ petition. 2 4' Learned counser for the petitioners submits that the petitioners are now are seekingl notional promotion to the post of school ,Assistants from the date of counseling held to the posts from 27.70.2005 to 05.11.2005. To that extent' he brought to the notice of this court the order dated 15.09.2023, passed in W.p.No.24505 of 2023. The relevant portion of the said order is extracted hereunder: "In view of the same and for reasons alike, this Writ Petition is disposed of at the admission stage in terms of the order dated 25.O4.2O23 .in W.P.No,tt563 of 2023, directing the respondents to extend the benefit of notional promotion to the post of School Assistant to the petitioners with effect from the date of counseling hetd to the said posts from ZZ.IO.2OOS to OS.tL.2OOS with ail conseguential benefits on par with similarly situated persons, within a period of eight (g) weeks from the date of receipt of a copy of this order.
