4. 'lhe thirteen Contract labourers, who were the employees ol- the contractor i.e. M/s M.K.R. Air conditioning & Refrigeration Works, have raised claims against the 'Principal \-1 2 employer' i.e. Indian Airlines for payment of gratuity for the period they worked on the premises of the Central Training trstablishment at Ferozguda, Secunderabad 11, for Air lndia on beha ll of Ind ian Airlines.

5. The factual matrix of the cases is as under: Indian Airlines Limited called for tenders for maintenance of air-conditioning-and-refrigeration-related rr,,ork. In the process, M/s M.K.R.Air Conditioning & Rcfrigeration Works was initially awarded contract for one year and subsequently, the period was extended. During the said period, workers in question have not raised any dispute with regard to their payment or any other benehts that they were cntitled to. Subsequentiy, however, they filed a Ciaim petition against Air India, claiming gratuity, after completion of contract before the Controlling Authority. They stated that Section 2l of the Contract Labour (Regulation and Abolition), Act 1970 also includes the amount of gratuit5z and since gratuify has not been paid to them for the period they were engaged by the principal employer, i.e., the Aii'India, they are entitled for the same.

6. In the claim petitions, Air India, in its counter, however, submitted that it is a works contract and not a manpower supply contract. Therefore, it is the sole discreLion of I I ) the contractor i.e. M/s M'K R' Air Conditioning & Refrigeration Works, to engrtge the workers for the work entrusted to them and there was absolutely no involvement of Air India to specify even the number of employees or other related issues to the contractor anrl added that its role as a principal employer' is confined only to supervise the payment of wages to the Iabour employed b1' the contractor for completion of works contract as per the Contract Labour (Regulation and Abolition) Act' 1970' Petitioner alsro, initially, submitted before the Controlling Authority thal- as per the definition of tmployer'the contractor - M/s. M.K.R. Air Conditioning & Refrigeration Works' is the 'employer' of petitioner, as deltned under Section 2(F) of the Payment ol Gratuity Act It is also contended that the Controlling AuthoritSr for the Air India is only the Central Government ancl not others, as it comes under the Ministry of Civil Aviation. It is further stated that 'employer' is clearly clefined under Scction 2 (F) of the Payment of Gratuity Act which also definecl 'employee' and they added that primary element which may Lrave to Lre required to be examined/clarified by the Controlling Authority is \'vhether applicant was an 'employee' of theContractor-M/sM.K.R.AirConditioning&Refrigeration Works or Air lndia, which engaged their services temporarily'' I t I 4 They further countered the contention of the rival submissions before the Controlling Authority that Air India has only paid I bonus besides 35 per extra minimum wages to the contract labour only in pursuance of the contract entered into with the contractor but, it is not, however, a statutory requirement, Air India aiso submitted that it paid bonus since the Payment of Bonus Act entitles any employee who worked for at least 30 days in any particular year and earning a wage or salary for that month. It is, therefore, a statutory payment and that bonus cannot be compared or equated with gratuity.

The Controlling Authority as well as the Appellate Authority allowed the claims hled by petitioners therein bv arriving at a linding that workers are entitled for gratuity since the respondent therein is a Government of India Undertaking which should be a Model Employer. Though, the graturty has not been rncluded as per [he Contract Labour (Regulation & Abolition) Act, they are entitled for gratuity, based on the above ground. Aggrievdd by the same, Air India filed Appeals before the Appellate Autho'rity i.e., Deputy Commissioner of Labour and it has argued the Writ Petitions, more or less, on similar lines, as advanced by them before the Assistant Commissioner I of Labour and Deputy Commissioner of Labour and Lhe same ) )t were dismissed by arriving at a hnding that Air India' being a Public Sector U ndertaking, shoutd act as a model employer and sinceithaspaidminimum\^.ages,bonus,gratuitycanalsobe paid bY it Tht: argument of petitioners is same as they argued 8. before the lowt:r authorities' This Court is of the opinion that theargumentisnotsustainable,sinceasaprincipalemployer, the duty of Air India goes much beyond just supervising the workofworkersandextendtotheimplementationoflabour laws and upL olding the spirit of the Constitution in right earnest and a.lso respecting values of equity and dignity of Iabour. The orders impugned therefore' do not \ Iarrant any interference arLd the Writ Petitions lack merits' g . costs.
