R&R/A2) epartment, dated 28.1O.2O19 are not applicable to this case sin e the Boda-Bonda Project was constructed belore 27.09.2013 a d hence it is not possible to consider the petitioner socicty's r ucst to issue hshing rights to Varadarajpur Villagcrs also. IL is submitted that thc total lncml)ership of the respondent No-7 socie[' is only 38- It is sr-tbmitt'-rl that Boda Bonda Project is being leased out in favour ol tl-rc Fishermen Cooperative Society, Dharmaram Village, since it lalls in the area of operation of the societl'. 'l'hus. acc:ordirlg lo ru:spondcnt No.3, the opcrational area of both the soc:ietics is specihcally prescribed and they can avail fishing rights in the respective areas of operation and the byc-lau-s o[ the socteties nrred to he amended to extend or reducc Lhe arca ol opcration. Lcarned counscl appearing lor thc responclenL No.7 has also filed a counter affidavit aclmitting t hat 5J Acres of land of Dharamram Vrllage and 32 Acres o[ Iand of Vardarajpuram Village are submerged in the Boda-Bonda Rcservoir. Flowever, it is stated that its total membcrship oi respolr.lent No.7 societf is 188 members and not 38 tncmbers as mct-ttiottecl by the respondent No.3 in his counter affidavit. It is tirrthcr submittcd that the petitioner society has already filccl W.P.\o.7186l2O2l 7/ 5 before this Court, '"vhtch ri'as disposed of directing the Commissioncr, Fisheries, to dispo c of the pending Arbitration Petition under Section (r L ol SCS Act for the proper adjudication and the salme \\'a decidcd by the Fishenes Commissioner vide orders date d ?,.O2.2023, holding that the petitioner therein is a resirlent ol Vardarajpuram Village, Markook Mandal, u'hich ri'zts n t includcd in the area of operation of the respondent No.7 ociety and therefore, it was not appropria[e to entortallt t]rt Ar irration Petition to admit the petitioner as members of thc I"CS, I)harmaram. No.74, dated 14.08.2018 6 and G.O.Ms.No.43, dated 28.10.20 19, clearl5' states that the same is applicable to l:he reservoirs and storage [anks constructed on or after )7 09 2Ol3 and sincc []oda-Bonda Reservoir was constructed in the year 199O, th(r same is not applicable. lt is furlher submilLed that thcr l:r rrd losers of Ac.32. 10 gts., have alreadl' been paid compcnsatioL-t as per the Compensation Act of 2013 long back and therclore ther arc nol entitled to the benehts of G.O.Ms No.74 and C].O.\Is No 43-

Vide G.O.Ms.No.74, the persons u'hosc lirnds ltitve bcen acquircd or the hshcrmen who were doLng lishirtg in smaller u,ater bodies and thc entire ulater boclies itave lrt'cn subsumed in thc reservoir or project, have bccn pelmittecl to seck fishing rights in the rcservoir or proicct. Hou,cvr:r G.O.Ms.No.43. has clarified that the bcnefits ol G.O.Ms.No 74 u,ould bc av:rilable onJy to the projccts r'vhich :rrr constrLtclcd 9 alter 27.O9.2O13.
