VIJAYSEN REDDY COMPANY APPLICATION No.71 OF 2025 IN COMPANY PETITON No.168 OE 2002 ORDER: (ORAL) This application is filed under Sections 528, 529, 529A and 530 of the Companies Act, 1956 read with Rules 139, 147, 148, 159,160'163, 173 and 174 of the Companies (Court) Rules, 1959 (for short 'Rules 1959') seeking the following reliet i) permit the off,rcial Liquidator to invite the claims from the creditors (including workmen) of tWs Sri Vishnupriya Industries Limited (In Liqn.) under Rule 148 of the Rules 1959. ii) permit the officiat Liquidator to advertise the notice to invite the claims lrom the creditors (including workmen) of the Company (ln Liqn.) in daily newspapers or any other newspaPers as may be decided by this Court on DAVP/Govemment rates and permit to incur necessary advertisement expenses from and out of the available tunds of the ComPanY (In Liqn.) iii) permit the ofhcial Liquidator to exercise all the powers required for adjudicationofclaimsreceivedfromthecreditors(including workmen) of the Company (ln Liqn') as per the provisions of the Rules, 1959. I 2 iv) order that the cost of this application do come out of the available funds of the Company (In Liqn.); and v) pass such further or other order or orders as this Court may deem fit . and proper in the circumstances of the case.

Heard leamed counsel appearing for the Official Liquidator, and perused the affidavit filed by the Official Liquidator in support of this application. 3 On perusal of the record, the Official Liquidator has stated that the funds position of the Company as on 18.02.2025 is Rs.2,69,29,0961- (Rupees two crores sixty nine lakhs twenty nine thousand and ninety six only). Considering the availability of funds, the Official l-iquidator intends to invite claims from the creditors of the Company by causing publication of notice in the 'Times of India', English daily newspaper (all editions covering the States of Telangana and Andhra Pradesh), 'Namasthe Telangana' Telugu daily newspaper (all editions covering the State of Telangana) and 'Andhra Jyothi' Telugu daily newspaper (all editions covering the State of Andhra Pradesh) or any other newspapers as may be directed by this Court and therefore seeks permission of this (lourt to invite claims against the Company in liquidation, dispensing with the issuance of individual notices to the creditors. 3

Having regard to the reasons stated in the accompanying affidavit' this application is allowed permitting the Official Liquidator to dispense with the issuance of individual notices to the creditors of the Company in liquidation and issue publication inviting claims from the creditors in 'Times of India', English daily newspaper (atl editions covering the States of Telangana and Andhra Pradesh), 'Namasthe Telangana' Telugu daily newspaper (all editions covering the State of Telangana) and 'Andhra Jyothi' Tetugu daily newspaper (all editions covering the State of Andhra Pradesh). The expenses for inviting claims are to be charged from and out of available funds of the Company' The Official Liquidator is also permitted to adjudicate the claims judiciously' There shall be no order as to costs.
