It is statr:r1 that the petitioner is the pattadar zrnd possessor of the agriculture land to an extent of Ac.O-21 guntas in Sy.No,1078/A/A situared at Gangadhara Village and Mandal, Karimnagar District. It is further stated that the name of the petitioner n,as rr:flected in all the revenue records as pattadar and the revenue aLlthorities also issued e-pattadar pass books under the provisions of the Teiangana Rights in Land and pattadar Passbooks Act, 2O2O. It is further stated that the petitioner has submitted F-t-ineapplication No.DER022501129ig31, dated 16.0 I .2025, bi' paying requisite fee to conduct survey of the subject land :rnd lix the boundaries. The grir:r,ance of the -_.{j"rBt+ 2 petitioner is that even after receiving the said F-Line application, the respondent authorities are not conducting survey and fixation of the boundaries. 3 Considered the submissions of the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent this writ petition is disposed of at the admission stage. Learned counsel for the petitioner has submitted that in 4. terms of the circular issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessary charges'
5. lrarned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the respondent authorities will consider the aforesaid F-Line application submitted by the petitioner by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries. It is settled law that the Survey Department has the 6. authority to conduct survey and demarcate lands in accordance with the provisions ofthe Telangana Land Revenue Act, 1317 Fasli l (Act No. VIII of 1317 Fasli), the Telangana Survey and Boundaries Act, 7923, and rhe Rules framed thereunder. The Goyernment has issued various ,:irculars specifying the conditions for conducLing surveysr partri:ularly F-Line (held measurement) surveys. Individuals reqltesting such surveys are required to sr:bmit specific documents, anr: il the conditions stipulated in the circulars are fulfilled, thc survey and boundary fixation may be conducted. The Commissioner, Surrvey, Settlements and Land Recor,Cs, exercising powers under r he Telangana Survey and Boundar.ir:s Act, 1923, issued relevzrr-rt circulars from time to time .vide Rc.No.N1/6543r 99, dated 2S.O7.2OOl, Rc.No.Nt/1408/07, dated 13.07.2OO7, .rnd Rc.No.N2/ t74t/2OtO, datecl 18.0S.2010 stipulating the :onditions for conducting survey of private lands and as per th r said circulars, il the petitioner f.rlfills all the conditions o[ the said circular, it is an obligation for the respondents to (.onduct survey within the time specihed in the said circulars. In view o I the aforesaid discussion, this Court deems it rlispose of this writ petition directing respondent appropriate No.4 to exalrinc No.DER0225O 7129183, the petitioner F-Line application uide dated 16.01.2025 su omitted for conducting survel.and demarcation by fixing boundary stones to <_. -q 4 t the petitioner land to an extent of Ac.0.21 guntas each in Sy.No. \O78/A/A situated at Gangadhara Village and Mandal, Karimnagar District and if the petitioner fulfills all the conditions mcntioned in the circulars issued by the Commissioner, Survey, Settlements and Land Records from time to time, after issuing notices to all the persons interested and adjacent pattadars and after considering their objections, respondent No.4 shall conduct survey of the aforesaid land, within a period of eight (8) weeks from the date of receipt of a copy of this order.
