JUDGMENT:
This Appeal Suit, under Section 96 of the Code of Civil Procedure, 1908, is directed against the Judgment and Decree, dated
18.01.2010, in O.S.No.178 of 2007 on the file of the Senior Civil Judge, Kadapa, whereunder and whereby, the suit was decreed with costs against the appellant for Rs.5,88,315/- with future interest at 6% per annum on the principal amount of Rs.3,60,000/- from the date of suit till the date of realization.
Heard both sides and at their request and as the learned counsel for the appellant stated that the appellant is ready to pay the decretal amount by way of instalments, the appeal itself is taken up for disposal.
There shall be interim stay subject to condition of the appellant depositing Rs.2,00,000/- (Rupees Two Lakhs) in the trial court on or before 27.04.2010, and the remaining decretal amount, together with costs and interest, shall be deposited within a period of six months from today. On such deposit the respondent herein is entitled to withdraw the same. In case, if any of the above two conditions has not been complied with, the stay shall stand vacated without further reference to the Court.
Operative part
