BHASKAR REDDY WRIT PETITION No.5281 of2o.25 ORDER: This Writ Petition is hled praying this Court to declare the action of the respondents in not considering the application, dated 14. 1 I .2022 slubr.r,itted by the petitioner seeking for deletion of the lands admeasuring Acs.g.21 guntas in Sy.No.590; Ac.O.2O guntas in Sy.No.603/4A; Acs.g.13 guntas in Sy.No.6O3lEE; Acs.3.23 guntas in Sy.No.606lA; Acs.6.35 guntas in Sy.No.619 and Acs.4.25 guntas in Sy.No.620/A, situated at Rudraram Village, patancheruvu Mandal, Sanga Reddy District, from the prohibited properties as illegal, arbitrary and violative of the provisions of the Telangana Rights in Land and Pattadar Passbooks Act,2O2O (for short.the Act 9 of 2O2O") and consequently, prayed for ot_her appropriate reliefs.

It is stated that the petitioner is the owner and possessor of the land admeasuring Acs.8.2l guntas in Sy.No.S9O; Ac.O.2O guntas in Sy.No.603/AA; Acs.S. t3 guntas in Sy.No.603/EE; Acs.3.23 guntas in Sy.No.6O6lA; Acs.6.35 guntas in Sy.No.619 and Acs.4.25 guntas in Sy.No.62O/A, situated at Rudraram Patancheruvu Mandal, Sanga Reddy District, having Village, I acquirqd through succession from his father and also through i i 2 CVBR, J \\'p_5281 2025 registered sal,r deed bearing document No 2743 of 20C 1, dated i5.05.20()1. t is further stated that the names of the lretitioner and his pre c.ecessors-in-title have been recorded in all the revenue records and the revenue authorities also issued pattadar pass;book No.TO918001O532 uide Khatzr No 1 141 in favour oI the petitioner under the provisions of the Act 9 of 2O2O. )t is lr-Lrther stated that the respondents, without taking into considera.tron of all the documents, have mentioned the subject property as prohibited property in Dharani Portal and soon attr r noticing the same, the petitioner has tnade an applicaticn, ,lated 14.1I.2022 seeking for deletion of th: subject propert-v as prohibited property in Dharani Portal. The grievanr;e of the petitioner is that even after receiving the said applicaticn, the respondent authorities did not cons;ider the same.

4. Sri L. Rzrvinder, learned Assistant Government Pl :ader for Revi:nur: 1as rot disputed the fact that the nature of the land is t I 3 CVBR, J Wp 5281 2025 classified as patta land and issuance of pattadar passbook in favour of the petitioner.

It is settled law that once the nature of the land is shown as patta land and pattadar passbook has been issued in favour of the petitioner, the respondent authorities are not having any power or authority to notify the subject property as prohibited properties either in Dharani portal or in the list of prohibited properties maintained under the provisions of the Registration Act, 19O8.

In the said circumstances, this Court deems it appropriate to dispose of this writ respondent authorities to examine the application, dated 14.17.2022 uide Transaction ID No. 193459O0O018708 and duly taking into consideration of the documents enclosed by the petition directing the petitioner, consider the same and if the petitioner is otherwise not eligible for deletion of the subject property as prohibited property in Dharani Portal, the respondent authorities shall pass a reasoned order and communicate the same to the petitioner, within a period of eight (08) weeks from the date of receipt of a copy of this order. i I 4 CVBR, J \\'p 5281 .2025
