Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 and 2 in not considering the request of petitioners to give them seniority over and above respondents 3 to 5 and other similady placed Personnel Officers as per the seniority in the cadre of Assistants cum computer Operators and seeking to effect further promotions to the posts of Asst. Secretaries without finalizing seniority in the cadre of Personnel Officer as illegal and arbitrary and in violation of Articles 14 and 16 of the Constitution of lndia and consequently direct the respondents to restore the seniority of petitioners above respondents 3 to 5 and other similady placed Personnel officers as per the seniority in the cadre of Assistants cum computer operators with all consequential benefits and thereafter effect further promotions to the posts of Asst. When the matter is taken up for hearing, Sri N. praveen Reddy Reddy, Iearned counsel appearing for the petitioners, submits that during the pendency of the present writ petition, respondent No.t has issued a provisional seniority list of personnel officers of TGNpDCL as on 3I.07.2024, vide Memo. No.CMS/C(HRD&Trgl/cM(S)/AS(Es ttl / pO. A / 28O _ A3 / 24 dated 23.08.2024, wherein, tJle petitioners were placed at SI.Nos. 12, 13 and 16 respectively. Further, respondent No.1, through the very same memo, had a-lso called for objections to the provisional seniority list, within fifteen days from the date of its issuance. However, even as on date, the said seniority list has not been rrnarized. Therefore, learned counser for the petitioners ( _7 2 PK, J W.P.No.5458 of 2020 prays this Court to permit the petitioners to submit their objections to the said provisional seniority list and seeks a direction to the respondents to fnalizr- the seniority list duly considering the objectionr; of the petitioners within a stipulated period.
3. Sri A. Chandra Sekhar, learned Standing Counsel lbr the respondents fairly submits that the respondents will consider the objections of the petitioners, as and when received, and effect promotions in accordance with law. 4- Having rega-rd to the submissions made by rearn,:d counsel for the respective parties, without going into merits of tJre case, r:he Writ petition is disposed of permitting the petitioners to submit treir objections to the provisional seniority list dated 31.o2.2024, within a period of two (02) weeks from the date of receipt of a copy of this order. on receipt of such objections from the petitioners, the respondents shall consider the same, finalize the seniority list, and accordingly, effect promotions to the higher cadres, as expeditiously as possible, strictly in accordance wit]1 law.
