2. Heard Mr.P.Ramachandran, leamed counsel for the petitioners and Mr.S.Srinivas Reddy, leamed Assistant Government Pleader for Land Acquisition of respondents.

3. With the consent of learned counsel for the parties, the writ petition is being disposed of at the stage of admission.

4. Facts giving rise to filing of this writ petition briefly stated are that the petitioners are claiming that they are the residents of Cheerlavancha Village and Mandal, Siricilla District and the respondent authorities acquired the respective houses belonging to the I 2 petitioners, through notification issued under Section 4(1) of the Land Acquisition Act, 1894, for the purpose of Mid Manair reservoir. The Land Acquisition Officer, subsequently passed awards under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for brevity 'Act 30 of 2013') and determined meager compensation. Not satisfying with the amount determined by the Land Acquisition Officer, petitioners have submitted application dated 25.05.2016, before respondent No.2, requesting him to refer the matter to the authority under Section 64 of the Act 30 of2013. When respondent No.2 failed to consider the same, petitioners have submitted representations dated 28.10.2024, 04.1+.2024, 11.11.2024, t4.11.2024, 16.n.2024, 18.r1.2024, 19.1r.2024, 06.12.2024,

10.12.2024, 13.12.2024, 16.12.2024, lj.t2.2024 and t9.12.2024. In spite of the repeated requests made by the petitioners, respondent No.2 has not taken any steps to refer the matter to the competent authority.

5. Learned counsel for the petitioners submitted that the petitioners have submitted representations dated 25.05.2016,

16.12.2024, 17.12.2024 and 19.12.2024 before respondent No2 within the stipulated time, as per the provisions olthe Act 30 of 2013' requesting him to refer the matter to the competent authority and enhance compensation. Till date, respondent No'2 has not taken any steps to consider the same and the action of respondent No'2 is contrary to the provisions of the Act 30 of 20 13 '

Leamed Assistant Govemment Pleader submitted that if the representations submitted by the petitioners are in accordance with the Act 30 of 201 3, respondent No.2, will consider the same and refer themattertothecompetentauthority,undertheprovisionsofSection 64oftheAct30of20l3andrequestedthisCourttograntreasonable time.

7. Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that the petitioners have submitted representation to respondent No.2 on 25.05.2016, subsequently on 28'10'2024' t t
