MADHAVI DEVI trIRIT PETITIO N No.4998 of2O25 ORDER: In this writ petition, the petitioner is aggrieved by the action of the respondents in proceeding with the laying of road in Sy.No.774 to an extent of Ac.0.3O guntas out of Acs.4.04 guntas situated at Panyal Village, Hathnoora Mandal, Sangareddy District under Upadi Hami Pathakam through his land without initiating land acquisition proceedings and without pa)4ng compensation, as illegal and arbitrary.
2. The petitioner claims that the respondents, without following due process of law, without acquiring the land and without paj4ng any compensation to him, have laid the road though his land.
3. Respondent No.4 has filed a counter stating that the \ road has been laid as per the Gram Panchayat resolution dated 08.01.2025 under Upadi Hami Pathakam and that no road has been laid in the land of the petitioner, but they have only strengthened the existing road. 2 i I
4. Learned counsel for the petitioner, however, refuted the said contention and submitted that the road has been laid in the petitioner's land only.
5. In order to resolve the issue, this Court directs respondent No.2 to conduct survey a]rld demarcate the petitioner's property and thereafter, if it is found that the road has been laid through the petitioner's land, acquire the said land by initiating land acquisition proceedings and pay compensation to the petitioner. The exercise of conducting survey shall be completed within a period of two months from the date of receipt of a copy of this order.
6. Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending in this writ petition, shall stand closed. //TRUE COPY// SD/. A.
