O R D E R :
This Criminal Petition is filed under section 482 Cr.P.C., seeking to quash CC.No. 179 of 2009 on the file of the Court of II- Additional Judicial Magistrate of First Class, Rajahmundry including stay of all further proceedings pending disposal of the same and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor representing the State.
The learned counsel for the petitioner submits two grounds for appreciation of the matter; viz., the seal in the bank memo, it is stated as 2006 but whereas it is with handwritten as 2005 which creates a doubt about the authenticity of the said document. As far as this contention is concerned, this can be raised before the trial court. After its forged as forged one, the petitioner is at liberty to request the trial court to lodge a complaint. The next contention raised by the learned counsel for the petitioner is that the complaint is filed after 45 days but the said complaint is filed within time. Hence, this Court is not inclined to interfere with the proceedings pending before the trial court.
