Sale Deed Documents No. 2046, 2083,204i of 2000 to the petitioner, pending disposal of the above writ petition Counsel for the Petitioner: SRI T.K.SRIDHAR Counsel for the Respondents: SRI L.RAVINDER, AGP FOR REVENUE The Court made the following: ORDER 7h HON,BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.SO8O of 2o25 ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "....to issue a wit, ord.er or direction more particularly one in the nahfie of writ of Mandamus declaing the action of respondent Nos.2, 3 and 4 in not furnishing the copies of 1) Proceedings No.B4/ 346/ 95 of RDO Sanga Reddg, 2) Proceedings No.B4/ 55/ 89 of RDO Sanga Reddg and 3) Sale Deed Documents No.2O46, 2083, 2047 of 2O00 relied for not enteing mA claim of 38 Guntas uide my Dharani application No.2300100115 Dated 22.06.2023 as illegal, arbitrary and in utolation of Articles 14, 21 and 300A of the Constitution of lndia and consequentlA direct the respondent' authoities to fumish the copies of the proceedings 1) Proceedings No.B4/346/95 of RDO Sanga Reddg, 2) Proceedings No.B4/55/89 of RDO Sanga Reddg and 3) Sale Deed Documents No.2046, 2083, 2047 of 2000 to the petitioner in the interest of Justice . . . . "

2. Considered the submissions of the learned counsel for the petitioner, Sri L. Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents and perused the record.

It is stated that the petitioner is the owner and possessor of land to an extent of Acs.7-20 guntas situated at Nizampur Village, Sadashivpet Mandal, Sanga Reddy District, having purchased the same through registered sale deed bearing document No.51 of 2O13, dated 05.01.2013. It is further stated that when land to an extent of Ac.0-38 guntas out of Ac. 1-38 guntas in Sy.No.403 is missing in the Dharani Portal, she filed an online application, dated 2

22.06.2023 for passbook data correction and when the same was not considered, she Iiled W.P.No.15533 of 2023 before this Court and the said writ petition was disposed of uide order, dated

04.O7.2023 directing respondent Nos.2 to 4 therein to consider the online application, dated 22.06.2023 submitted by the petitioner in Dharani Portal and for issuing e-pattadar passbook for the said lands, by issuing notice to all concerned/interested persons, within a period of forty five days from the date of receipt of a copy of the order; and in pursuance of the said order, respondent No.2-District Collector passed order, dated lO.O9 .2024 in Case No.F3/ L899 12023 rejecting the claim of the petitioner for incorporation of the missing extent of lands. It is further stated that thereafter the petitioner filed a representation, dated

21.12.2024 before respondent No.2 seeking to furnish copies of the documents, which are basis for mutating the names of the third parties in the revenue records in respect of the said lands, and despite receiving the said application, the respondent authorities have not furnished the copies as sought by her. Hence, this writ .! petition.

4. karned Assistant Government Pleader for Revenue appearing for the respondents has not disputed the submission of the application by the petitioner. 3 In view of the above and since the respondent No'2 has 5. rejected the claim of the petitioner for mutation of her name in the revenue records in respect of land to an extent of Ac'0-38 guntas out of Ac.1-38 guntas in Sy.No.403, this Court deems it appropriate to dispose of this writ petition permitting the petitioner to make an application under the provisions of the Right to Information Act' 2005, on the file of the concerned authority seeking information of the proceedings, which are basis for mutation of the names of the third parties in respect of the said lands' On filing such application, the respondents are directed to furnish the information sought by the petitioner, within a period of four (4) weeks from the date of Iiling such application to enable her to avail remedies as available in law.
