JUSTICE SUREPALLI NANDA WRI PETITIO NNO;4 743 of 2025 o DER: Heard Sri Pramod Singh, learned counsel appear'ng on behalf of the petitioners and Sri N' Sreedhar Reddy' TSSPDCL, aPPearing on learned Standing Counsel for behalf of the respondents' The petitaoners approached the Court seeking prayer 2 as under:- "...to issue any writ order or direction more in the nature bf Writ of Mandamus declaring the action of the respondents in disconnecting the power supply to the petitioners service connection numbers M3-9417 and M3-10431 of premises bearing D'No'19-2-21UC' Ramnasthpura, Near Zoo park' Hyderabad' without issuing any show cause notice' as illegal' arbitrary' contrary to law and in violation of principles of natural justice and consequently direct the respondents to forthwithrestorepowersupplytothepetitionersS,C. Nos.M3-9417 and M3-10431 and to pass such other order or orders as this Hon'ble Court may deems fit and proper in the circumstances of the case'"
3. The case of the petitioner in brief is that the petitioner No.2 Industry is manufacturing Ice Cubes' and is located in \ !r- \EEEKA \:f \ 2 premises bearing No. D. No.19-2 -2Lt/C, Ramnasthpura, Near Zoo Park, Hyderabad. The petitioner No.2 obtained LT Category III service connection bearing No.M3-9417 fronr the respondents. The petiticner No.1 is engaged in oil business and obtained service connection L.T. Category III Service (:onnection bearing No.M3-10431. The petitioners had been paying electricity consumption charges to the respondents without any default. Thereafter, the respondents have issued impLrgned notice dated
28.07.2025; to the petitioner No.1 threatening to disconnect the power supply if pending dues of Rs.35,743i- are not paid in respect of SC.No.M3-10431 to the petitioner No.1 premises and also similar notice dated t7.A7.2025 was issued to the petitioner No.2 threatening to disconnect the power supply if ACD amount of Rs.7,97,736l- was not paid as against SC.No.M3-9417. Subsequently, the petitioners had paid the due amounts of electricity consumption charges and there were no dues pending. The respondents without issuing any notice, or affording any opportunity of hearing, straight away disconnected the power supply to the petitioners service connections on 15.02.2025 on the ground that Kwality Ice Industry did not pay the due amount and on the ground that the petitioners service connections are l linked services. Aggrieved by the saffi€' the petitioners filed the present writ Petition. PERUSED THE RECORD.
4. Sri N. Sreedhar Reddy, learned Standing Counsel for TSSPDCL, appearing on behalf of the respondents submits that the writ petition could be disposed of directing the petitioners to make a detailed representation to the respondents putting forth to the notices issued bY the their grievances in resPonse herein and the same maY be respondents to the Petitioners directed to be considered by the respondents in accordance to Law, within a reasonable Period' 5 T o ID RA ION TA N a) The facts and circumstances of the case and' b) The submissions made by the learned counsel appearing on behalf of the petitioners and the learned Standing Counse! for TSSPDCL, appearing on behalf of the respondents, The Writ Petition is disposed of directing the petitioners to make a detailed representation to the respondent Nos.4 and 5 herein putting forth the l 4 petitioners grievances as put forth in the present writ petition against the notice dated 28.O1.2O25 issued to the 1"t petitioner and against the notice dated 17.01.2025 issued to the 2nd petitioner, within a period of one (01) week from the date of receipt of a copy of the order and upon receipt of the said representation of the petitioners, the respondent Nos.4 and 5 shalt consider the grievances of the petitioners as put forth by the petitioners in the said representation pertaining to the notice dated 28.O1.2025 issued to the l't petitioner and against the notice dated 17.O1.2O25 issued to the 2nd petitioner, in accordance to law, in conformity with principles of natural justice and pass appropriate orders, within a period of one (O1) week thereafter. Till the above exercise is completed and appropriate orders, passed by the respondents 4 ancl S, the respondents 4 and 5 shall not initiate any coercive eteps against the petitioners in pursuance to the impugned notices dated 17.O1.2O25 and
28.01.2025 issued to the petitioners. The respondents are also request of the petitioners for directed to consider the restoration of the power I l I I 5 supply to the petitioners' service uonnection Nos'M3-9417 and M3-10431 of premises bearing No'19-2-211/C' Ramnasthpura, Near Zoo Park, Hyderabad within a period of one (1) week from the date of receipt of the copy of the order.
