LAKSHMAN WRIT PETITION No.4642 OF 2025 ORAL ORDER: Heard Mr.Sk.Shabber Ahmed, learned counsel for the petitioner, learned Assistant Government Pleader for Municipal Administration and Urban Development for respondent No.1 and Mr.Midde Arun Kumar, learned Standing Counsel for respondent Nos.2 to 4

The petitioner herein is claiming that it is the absolute owner and possessor of Villa No.L4 and also developer of the property in plot Nos.Ul, U2, U3 and U4 situated in Sy.Nos.20l I and 20/2, Road No.7, Banjara Hills, Hyderabad, pursuant to the building permit order dated 25.08.2014. It is the specific contention of the petitioner herein that respondent No.5 has purchased Villa No.U4 consisting ground + 2 upper floors in the subject property i.e., house bearing No.8-2-545, known as 'Prem Parvat by PVP', Banjara Hills, Hyderabad, under the registered sale deed bearing document No.2529 of 2019, dated 17.O4.2O19. Respondent No.5 is making construction of two floors over and above the 2 ground + 2 upper floors. The same is unauthorised, Therefore, the petitioner herein has submitted a representation dated

06.O2.2025 to respondent Nos.2 and i with a r-equest to take action against respondent No.5. Despite receiving and acknowledging the said representation, respondent Nos.2 and 3 did not act upon the same. Aggrieved by the said inaction of respondent Nos.2 and 3, the petitioner filed the present writ petition.

Whereas, Mr.Midde Arun Kumar, learned Standing Counsel for respondent Nos.2 to 4, on instructions, would submit that respondent No.3 will consider the said representation dated 06.O2.2025 submitted bv the petitioner and inspect the site, if the allegations made by the petitioner are found to be true, he will take action against respondent No.5, strictly in accordance with the procedure laid down under the Greater Hyderabad Municipal Corporation Act, 1955 by putting the petitioner and respondent No.5 on notice and affording them an opportunity of hearing.

4. In the light of the said submission, notice to respondent No.5 is dispensed with. This Writ petition is disposed of, 3 directing respondent No.3 to consider the representation dated 06.O2.2025 submitted by the petitioner and inspect the site, if the said allegations made by the petitioner are found to be correct, he shall take action against respondent No.5, strictly in accordance with the procedure laid down under GHMC Act, 1955, by putting the petitioner and respondent No.5 on notice and affording them an opportunity of hearing. He shall complete the said exercise within four (4) weeks from the date of receipt of a copy of this order. In the circumstances of the case, there shall be no order as to costs.
