SAM KOSHY Civil Revision Petition No.6O4 of 2025 ORDER : The instant Civil Rerrision Petition has been filed by the I i petitioner under Article 227 of the Constitution of India aggrieved by the Docket Order dated 21.10.2024 in I.A.No.516 of 2024 in I.A.No. 151 of 2Ol9 in O.S.No.239 of 2Ot9 passed by the V Additional District Judge, Ranga Reddy District, at L.B. Nagar (for short, 'the impugned Order'f .

2. Heard Mr.G.V.L. Murthy, learned counsel for the petitioner / defendant No.8

3. Vide t!l,e impugned order, the Trial Court directed the police Kandukur to provide AID to the respondent No.1 / plaintiff herein for implementation of the injunction order passed in I.A.No. l5l of

Today, u,hen the matter was taken up for hearing, learned counsel for the petitioner submitted that the order of injunction gralted by the Trial Court is already under challenge by way of an appeal, viz., Civil Miscellaneous Appeal No.41O of 2024, which is pending before this Court. He further submitted that there has been no interim relief granted by the High Court in the said Appea-l challenging the order of injunction dated 01.04.2024 passed in I.A.No. 151 of 2019 in O.S.No.239 of 2OL9

Therefore, in the absence of any interim protection granted by this High Court in the said appeal, the Trial Court allowing the application, vtz I.A.No.15l of 2Ol9 in O.S.No.239 of 2019 providing for police protection to the respondent No. 1 / plaintiff herein, cannot be found fault with while exercising the supervisory jurisdiction of the High Court under Article 227 of the Constitution of India.

The petitioner / defendant No.8, having challenged the order of injunction before the High Court vide C.M.A.No.4LO of 2024, the only remedy available to him as of now would be to get the appeal decided on merits to contest the order of inj unction granted on 01.04.2O24 in I.A.No. 151 of 2Ol9 in O.S.No.239 of 20 19, based on which the fate of the Docket Order dated

21.10.2024 in I.A.No.516 of 2024 in I.A.No. 151 of 2Ol9 in O.S.No.239 of 2Ol9 r*'ould be automatically decided. I

7. For all the above reasons, the Civil Revision Petition being devoid of merit fails and the same is accordingly dismissed. No
