2. Heard Mr.V.Roopesh Kumar Reddy, learned counsel for the petitioner, Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondents No.1 to 9 and Mr.A. Raghuram, learned Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents No.9 to 11 Y 2

3. The petitioner's case rests on two principal grounds. First, the petitioner seeks a direction for entrusting the investigation in Crime No 27 of 2017 and Crime No.539 of 2017, which are presently on the files of respondents No.7 and 8 respectively, to an independent or alternate investigating agency to ensure a fair and impartial investigation. Secondly, the petitioner prays for a direction to respondents No.10 and 11, the Assistant Commissioner of Police and the Station House Officer, respectively, to initiate appropriate action based on the petitioner's representation dated 04.07 .2017 against respondent No. 1 3.

4. Learned Assistant Government Pleader for Home submits that the investigation in Crime No.27 of 2017 has been duly completed and a charge sheet has been filed. Consequently, the case has been taken cognizance of and numbered as C.C. No.4096 of 2023 on the file of the learned V Metropolitan Magistrate, L.B. Nagar, Ranga Reddy District. With respect to Crime No.539 ot 2017, it is submitted that, after thorough enquiry, the lnvestigating Officer filed a final report dated 30.04 2018 classifying the case as "lack of evidence." lt is further contended that the petitioner's allegation of improper or biased investigation is unsubstantiated and unsupported by any material evidence. As regards the second relief sought, relating{Or'the representation daled 04.07.2017, it is contended that the petitioner _:) ought to have availed the statutory remedies provided under the Code of Ciminal Procedure, 1973, before invoking the extraordinary jurlsdiction of this Court under Article 226 of lhe Constitution of lndia. He further relies on judicial precedents holding that when efficacious alternative remedies under the Cr.P.C. are available, a writ petition under Article 226 is not maintainable

5. Learned Assistant Government Pleader appearing for respondents No.9 to '1 1 submits that the matter may be disposed of on the basis of the materials placed on record and in accordance with

6. lhave perused the pleadings and the materials placed on record.

With respect to the petitioner's contention regarding fair investigation, this Court finds no reasonable ground to infer that the investigation conducted by the concerned lnvestigating Officers suffered from bias or procedural irregularity. The materials on record reveal that in Crime No.27 of 2017, the investigation has culminated in the filing of a charge sheet, and the case has been taken cognizance of and is presently pending before the competent Magistrate. ln Crime No.539 of 2017, the lnvestigating Officer has submitted a final report concluding that there was a lack of sufficient evidence to proceed further. ln view of these developments, and in - 4 the absence of any demonstrable exceptional circumstances warranting interference. this Court finds no justification to direct transfer of the investrgation to another agency, particularly at this advanced stage of proceedings

As regards the petitioner's request for initiating action based on his representation dated 04.07.2017, it is a settled principle of law that a person alleging inaction on part of the police authorities must first exhaust the statutory remedies provided under the Code of Ciminal Procedure, 1973. fhe petitioner, if aggrieved by non- registration of an FIR or improper investigation, has the remedy under Sections 154(3), 156(3), or 200 Cr.P.C. to seek appropriate relief before the jurisdictional Magistrate. The Hon'ble Supreme Court in M. Subramaniam v. S. Janaki, (2020) 16 SCC 728, and Sakln Vasu v. Stafe of U.P, (2OOB) 2 SCC 409, has categorically held that when an alternative and efficacious statutory mechanism exists under the Cr P C., recourse to writ jurisdiction under Article 226 of the Constitution is not maintainable, except in rare and exceptional cases involving gross abuse of process or manifest illegality.

9. ln the present case, the petitioner has not demonstrated any such exceptional circumstance warranting exercise of this Court,s extraordinary jurisdiction. Therefore, in light of the seftled legal position and the facts and circumstances of the case, the prayer ) seeking a direction to respondents No.10 and 11 to initiate action on the petitioner's report dated 04.07.2017 cannot be entertained at this stage. 10, Accordingly, this writ petition is dismissed. However, liberty is reserved to the petitioner to avail the appropriate statutory remedies available under law if the cause of action still survives.
