Judgment
two revision petitions are being disposed of by this common order. 2 Both these revisions are filed under Section 115 of C.P.C. Petitioner herein is appellant in A.S.Nos.143 and 145 of 2009 on the file of the Court of the II Additional District Judge, Warangal. In the aforesaid appeals, the petitioner filed I.A.Nos.122 and 123 of 2011 under Order 41 Rule 27 R/w Section 151 C.P.C. seeking permission to produce some additional evidence. The court below, by relying on the decision of the apex court in AIR 2011 CC (45) and also on the decision of this Court in 2011 (3) ALT 392, directed the applications to be posted along with the main appeals. 3 The learned counsel for the petitioner in both the revision petitions submitted that the trial court should have decided the applications having regard to the nature of documents, which are sought to be filed, by way of additional evidence. 4 I see no irregularity or illegality in the order impugned in these revisions petitions. As much as the appeals are filed by the petitioner herein, the documents, which the petitioner sought to file as an additional evidence, can be better appreciated with regard to their relevancy when the appeals themselves are taken up for consideration. In that view of the matter, I do not find any ground to interfere with the impugned orders. However, I am sure that the appellate court will decide the relevancy of the documents, which the petitioner seeks to file as additional evidence with regard to the issues, which fall for consideration in the first appeals. 5 Subject to the above observations, these revision petitions are dismissed. No costs.
