Counsel for the Petitioner:MR.S.S.BHATT Counsel for the Respondents : GP FOR ENDOWMENTS The Court made the following :
O R D E R:
At the interlocutory stage, the writ petition itself is taken up for hearing and disposal with the consent of the learned counsel for the parties. Heard Sri S.S.Bhatt, learned counsel for the petitioner, and learned Assistant Government Pleader for Endowments respondents. The writ petition is filed questioning constitution of Trust Board. It is not in dispute that the Trust Board was constituted on 11-08-2005 and the said proceedings were suspended by this Court by order 24-08-2005. Inasmuch as the term for which the Trust Board was constituted has come to an end with the expiry of the two years period as envisaged in Section 15(3) of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987, the cause in the writ petition does not survive for consideration. Liberty is however given to the petitioner to question any future proposals by the respondents for constitution of a fresh Trust Board. The writ petition is, accordingly, dismissed as infructuous. As a sequel to dismissal of main petition as infructuous, WVMP No.3015 of 2005 is disposed of as infructuous. C.V.NAGARJUNA REDDY,J Dated 26th June 2008
