THE HON’BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION Nos. 23823 of 1998 & batch COMMON ORDER: Section 34 of the Armed Forces Tribunal Act, 2007 (Act No. 55 of 2007) mandates that every suit or other proceeding pending before any Court including a High Court immediately before the date of establishment of the Tribunal under the said Act, shall stand transferred on that date to such Tribunal. Headquarters, Andhra Sub Area, Secunderabad through their communication dated 26th October 2009 have taken up the matter with the registry of this Court, enclosing thereto the Gazette of India, Extraordinary, Part II and Section 4, Notification, dated 07th August 2009, wherein it has been notified that in terms of Section 4 of the Armed Forces Tribunal Act, 2007 (Act No. 55 of 2007, the Central Government has established the Armed Forces Tribunal with effect from 10th August 2009. In view of this Notification constituting the Armed Forces Tribunal with effect from 10th August 2009, all these proceedings being writ proceedings, shall stand transferred to the said Tribunal immediately. Registry, to transmit all the case files to the officer concerned of the Armed Forces Tribunal, Southern Regional Bench at Chennai immediately. ---------------------------------- 3rd November 2009
