This Criminal Petition has been taken out under section 482 of Criminal Procedure Code by the accused in Crime No.62 of 2008 of Station House Officer, Ainavalli Police Station, East Godavari District to quash the First Information Report therein. A report came to be presented by the Deputy Executive Engineer, Panchayat Raj, Amalapuram on 29.8.2008 alleging that the petitioners herein disturbed the B.T. road and blocked the road by putting big boulders. Basing on the report a case in Crime No.62 of 2008 came to be registered by the Station House Officer, Ainavalli Police Station for the offences under sections 314 and 283 r/w 34 IPC and section 3 of Prevention of Damage to Public Property Act, 1984. Hence, this Criminal Petition. Heard learned counsel appearing for the petitioners and learned Additional Public Prosecutor for the 2nd respondent-State. Learned counsel appearing for the petitioners submits that the 2nd respondent damaged the cattle shed of the petitioners and the second respondent apprehending initiation of proceedings by the petitioners presented report before the police with all false accusations. Learned Additional Public Prosecutor appearing on behalf of the 2nd respondent-State submits that a case in Cr.No.62 of 2008 came to be registered on the report of the Deputy Executive Engineer, Panchayat Raj, Amalapuram and in the said report specific accusations have been made by the petitioners and therefore the petition is not liable to be dismissed. I have gone through the report presented by the 2nd respondent before the Station House Officer, Ainavalli Police Station on 29.8.2008. It is stated in the report that the petitioners herein disturbed the B.T. Road and obstructed the way by putting big boulders. Such is the accusation levelled against the petitioners investigation cannot be interdicted at this stage. Accordingly, this Criminal Petition is dismissed. DT: 09-11-2011.
