The petitioner, a Fishermen Cooperative Society, has filed this Writ Petition questioning the proceedings No.361/E/2000, dated 16- 10-2000 issued by the second respondent-District Collector, Nalgonda District. The impugned order in Proceedings No.361/E/2000, dated 16- 10-2000 issued by the second respondent is only a general order constituting nodal agency for the purpose of verification of the members lists and weeding out bogus members. It is the case of the petitioner that the District Collector is not having competency and jurisdiction to pass said order dated 16-10-2000. Counter affidavit is filed on behalf of the respondents. It is stated in the counter affidavit that the District Collector by proceedings dated 16-10-2000 ordered for identification of the bogus members and to weed out them from the fishermen cooperative societies. It is stated in the counter affidavit that in case any removal of bogus member is to be done, the same will be exercised by the Assistant Director of Fisheries, Nalgonda, who is the functional Registrar of the Societies, as per the provisions of the AP Cooperative Societies Act, 1964. In view of the stand of the respondents, it is submitted by the learned Counsel for the petitioner that the Writ Petition may be disposed of keeping open the petitioner to challenge proceedings, if any, passed by the functional Registrar of the Societies for removal of the members adversely. In that view of the matter, the Writ Petition is disposed of keeping open for the petitioner to challenge the proceedings, if any, passed by the functional registrar of the Societies for removal of the members adversely.
