2. It is stated that the petitioner is the owner ald possessor of the aforesaid land, having purchased the same under registered sale deed uide document bearing No:6176 of 2076, dated 17.09.2016. It is further stated that since the respondents have not issued pattadar passbook in favour of the petitioner, she was constrained to make an application in the Dharani portal uid.e ID.No. TTMUO2t6Ol05646Z, dated 11.11.2016, before the respondents seeking for mutation and consequential issuance of pattadar passbook under the provisions of Telangana Rights in Land and Pattadar passbooks Act, l97l, (For Short "ROR Act, , 2 CVBR, J wp :+246_2025 lg7l)SAnd *rdr Rirles' made 'there under. The grievarrce of the petitioner is that even after receiving the said applicrrtion, the respondent au.teorities are not considering the same' ,l L,earned Assistant Government Pleader appeilring for 3. respondents r,'ehemently contended that as per Section + of ROR Act, 797L, if ieny person acquiring right over the prope:ly has to make an apprlication within 45 days for updating thrl revenue records and incorporation of their names and consr:quential issuance of pattadar passbook. Admittedly, in this t^"i', ttt' petitioner hars made an application in Dharani Porr'al, dated 11.11.2016 arr<l thereafter, petitioner has not taken pnl steps for disposal of the said application. Even if the application has not been disposect of within the time stipulated under the .Rules, the petitioner is lrziving remedy to approach the competent authorit5r by Iiling an appeal under Section 9 of the ROR Act, l9TJ seeking for issuance c,f pattadar passbook or filing writ petition before this Court. The petrtioner frled this writ petition seeking to corsider the application, dated 11.11.2016 i.e., almost aJter a delay of eight years. It is lurther submitted that the petitioner was alleged to have made th,e said application under the provisions of the ROR Act, 1971 an,C the sajd Act was repealed and replaced with the Telangana Rrglrts in Land and Pattad.ar Passbooks Ac:t, 2O2O. This Court, without expressing aly opinion on the right and entitlement of the petitioner for mutation of her name in the revenue records and since it is the case of the petitioner that she has purchased the propert5r under registered sale deed and her name Was not mutefed in the revenue records, deerlrs appropriate to dispose of the writ petition by permitting the petitioner to approach the competent Civil Court seeking appropriate relief and after obtaining the decree, she is entitled to make an application before the respondent authorities seeking for issuance of pattadar passbook. 5 Accordingly, this Writ petition is dismissed.
