Petitioners are claiming that they are the absolute owners and possessors of house bearing No'12-13-582/P2 (PTIN: 1291234220)inPlotNo.2inSurveyNo.l66(oldSurvey No.157/l) admeasuring 340 Sq' yards' situated at Lallaguda Village, Tarnaka, Secunderabad' on the strength of a registered Sale Deed bearing document No'873 of 2023 dated 20.03.2023. According to petitioners' 6'r' and 7'h respondents have encroached into the subject property and are proceeding with construction without obtaining permission from GHMC' The same is an unauthorized construction' Therefore' 1't petitioner submitted a representation dated 2OJ22024 to respondent Nos.2 to 5 with a request to take action against 2 KL..I , I' No +:199 0t 2025 \. - '1 6'h ancl 7'' rr:spondents. Therefore, l.t petition,:r has no locus trt rsrrf lnjg the said representation to responrlerrt Nos.2 to -5 and also rr Ille the present Writ petition. 1.' pcririo;rer is the father o1 1l ' p,:titioner. Though 2nd petitioner and h s friend, Mr. T. liadic. purchased the subject property, the said T. Sadiq 1 KL. J $ .P.No. r399 oI2O2_i is not before this Court and he has not even submitted a representatlon. In paragraph No'6 of the writ affidavit' petitioner has 5. specihcally stated that 1" petitioner has instituted a suit vlde O.S.No.665 of 2016 against respondent Nos'6 and 7 for perpetual injunction' The same was decreed on 03'04'2017'

6. Thus, there are disputes between petitioner aucl 6'h & 7'r' respondents with regard to the title over the sublect property' Therefore, respondent Nos'2 to 5 cannot decide the said title disputes. They will consider only threc aspects i'e" i) misrepresentation/supplession of facts; ii) false statement' if any, made by the applicant' and iii) construction in deviation to the building Permit order'
