2. Learned counsel for the petitioner submits that this Writ Petition is hled by the petitioner aggrieved by the order dated 1r.06.2021 in ST.No.95/2021/DlrO4O/2ot7 passed by respondent No.S-Special Tribunal, Karimnagar, which is illegal and arbitrary

Learned counsel for the petitioner further submits that the petitioner liled arr appeal before respondent No.3-Revenue Divisional Officer, Huzurabad, uide ST.No.!ri ;l2o2rlDlto4o l2ol7, under Section 5(B) read with Section 23 r Rights in Land and Pattedar Pass Books Act' 1! f the Telangana : 71, against the mutation proceedings dated O7.1O.2O25 in File Nrr passed by respondent No.4-Tahsildar, in favorr ROR/26sl 198e ' of respondent No.6, in respect of the land in Sy.No.454/A, .o an extent of Ac.2.O6 guntas, situated at Etlandakunta Villagr: Subsequently, the said appeal was transmitted to responde Tribunal in view of the amendment of the i nt No.5-SpeciaJ OR Act as the Telangana Rights in Land and Pattadar Pass Boo.< s Act, 2020.

5. l,earned counsei for the petitioner further srr rbmits that after receiving the appeal, the respondent No.5-!l recial Tribunal, without issuing notices to the petitioner ('1 the unofficial respondents and without assigning any reasorll , dismissed the appeal uide order dated 22.01.2021. However, a s per the orders dated 18.03.202 1 passed by the Division Benclt of this Court in W.P.(PIL).No.20 of 2O2l and in view of the Telang ma Bhu Bharati (Record of Rights in Land) Act, 2025, the appellz te authoriQr was required to rehear the matter. ln view of the same, the said appeal was reopened and the present impu59 Led order dated ll.06.202l rvas passed on the same lines as tF dated 22.01.2021, without giving any reaso: e previous order rs and without considering any of the contentions raised by th': petitioner or the t I respondents, rendering it a cryptic order. Therefore, learned counsel submits that this is a Iit case for remanding the matter to the l"t appellate authority under Rule- 14 of the Telangana Bhu Bharati (Record of Rights in Lands) Rules, 2025 (for brevity "the Rules, 2025") for fresh consideration, issuing notices to the petitioner and unofficial respondents, alfording them an opportunity of hearing and as such, prayed to allow the Writ Petition by setting aside the impugned order dated 1I.06.2021.

Learned counsel for respondent No.6 has fairly conceded the submissions made by learned counsel for the petitioner that the impugned order dated ll.06.2O2l was passed without issuing any notices and without assigning any reasons. Learned counsel expressed no objection to remanding the matter to the 1.t appellate authority under Rule 14 of tJle Rules, 2025, for lresh consideration and prayed to pass appropriate orders.

7. Accordingly, this Writ Petition is disposed of and the impugned order dated 11.O6.2O2L passed by respondenr No.5- Special Tribunal in ST.No.95/2021 /DllO4O/2017 is hereby ser aside.
