The Detitioner apDroached the Court seekinq Drayer as u nder: "...to issue a Writ, Order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents particularly Respondent no:3 & 4 in interfering with peaceful possession and enjoyment of the petitioner's property (Old House Bearing No.6-2-9l1) in Babu Camp Village, Chunchupally Mandal, Bhadradri Kothagudem District without considering the petitioner's explanation dated: 14/ll/2023 is illegal, arbitrary, unreasonable and contrary to the law and violation of Article 14,21 & 300-A of Constitution of India apart from violation of principles of natural justice and consequently direct the respondents not to interfere with the peaceful possession & enjoyment of the petitioner's property (Old House Bearing No: 6-2-911) in Babu Camp Village, Chunchupally Mandal, Bhadradri Kothagudem District I ? The case of the petitioner, in brief, is that the petitioner is the absolute owner and possessor of the House Bearing No.6_2_ 9/1, Babu Camp Village, Chunchupally Mandal, Bhadradri_ Kothagudem District. The Gram panchayat, Babu Camp Village had issued a notice dated 24.06.2021 to the petitioner informing him to maintain the sanitation around the petitioner,s house. When the petitioner has demolished his tin roof house to construct a new house, taking advantage of the petitioner,s property being vacant, the respondents have erected the board stating that the petitioner's property belongs to the Government SCCL, without having any authority over the petitioner,s property and threatened to dispossess the petitioner from the property.

It is the specific case of the petitioner that inspite of petitioner's representation dated 14.11.2023 addressed to the respondent No.3 herein seeking appropriate direction to the concerned to remove the sign board posted in the petitioner,s subject property and to return back the tin sheets and iron rods taken away by the security staff of the respondent No.3 herein, I I (' l w 4129 2025 the grievance of the petitioner as put-forth vide the said SN,J representation, had not been considered by the respondent No.3 as on date. Aggrieved by the same, the petitioner approached the Court by filing the present writ petition.

Sri P.Sri Harsha Reddy, learned Standing Counsel for Singareni Collieries Company Limited appearing on behalf of the respondents, upon instructions, submits that the respondent company is not interfering with the petitioner's peaceful possession and enjoyment of petitioner's property and appropriate action in accordance to law would be initiated upon the petitioner's representation dated L4.Ll.2023 addressed to the respondent No.3 herein. 6, Takino into consideration: a) The facts and circumstances of the case, b) The submissions made by the learned counsel appearing on behalf of the petitioner and the learned Standing Counsel for Singareni Collieries Company Limited appearing on behalf of the respondents c) The contents of the petitioner's representation dated 14,LL.2029 addressed to the respondent No.3 herein and, I I I I ! 4 SN,J wp-4t29 2025 d) The fact that the representation of the petitioner dated 14.11.2023 is pending for consideration by the respondent No,3 as on date, The writ petition is disposed of directing the respondent No.3 to consider the gflevance of the petitioner as put-forth vide petitioner,s representation dated L4.LL.ZOZ3 add'ressed to the respondent No.3 herein pertaining to giving specific directions to the concerned for removal of the sign board posted in petationer's subject property i.e., Old House Bearing No.6_ 2-9/L in Babu Camp Village, Chunchupally Mandal, Bhadradri Kothagudem District and return back the tin sheets and iron rods belonging to the petitioner which had been taken away by the staff of the respondent No.3 i.e, security of the respondent No,3 herein and pass appropriate orders in accordance to law within a period of two(2) weeks from the date of receipt of a copy of this order and duly communicate the decision on the said representation to the petitioner herein.
