HON’BLE SRI JUSTICE V.ESWARAIAH C.R.P.NO.484 OF 2010 ORDER: Petitioners herein are defendants. The 1st respondent herein filed the suit O.S.No.33 of 2009 on the file of the III Additional Junior Civil Judge, Chittoor, seeking a decree of injunction simplicitor. The said suit is a recent one and even before the commencement of the trial of the suit the plaintiff filed an application under Order VI, Rule 17 C.P.C. seeking amendment of the boundary in the plaint schedule property. Having regard to the facts and circumstances of the case, I am of the opinion that under Order VI, Rule 17 C.P.C., the court shall allow such an amendment, if it is necessary, for the purpose of determining the real questions in controversy between the parties. Therefore, I do not see any infirmity legal or otherwise in the order impugned. The civil revision petition is accordingly dismissed. No costs. _______________ V.ESWARAIAH, J.
