RAJENDRA PRASAD The Court made the following: ORDER '------1/ /_ THE HON'BLE SRI JUSTICE C.V.B HASKAR REDDY WRIT PETITIOIT No.3737 of 2O25 ORDER: This writ petition has becn frled seeking to declare the action of respondent Nos.2 to 5 in trying to disburse the compensation amount in favour of respondent No'6 in respect of agricuitural land admeasuring Ac.l.2O guntas in Survey No.506/A, situated at Geesugonda Revenue Village and Mandal, Warangal District, despite pendency of civil suit vide O'S'No'379 ol 2016 on the hle of learned Principal Senior Civil Judge at Warangal as illegal, arbitrary and violation of principles of natural justice. Thc petitioner claims to be the absolute owner and possessor of agricultural land, admeasuring Acs'3'00 in Survey No.506/A, situated at Geesugonda Revenue Village & Mandal, Warangai District, having acquired thd same through will deed d.ated. 27.10.2025 executed by her mother late Smt' Orati Mallamma. It is stated that while the said land of the petitioner has been acquired by the respondent authorities for the purpose of establishment of Textile Park, the petitioner's brother i'e', respondent No.6 herein, who is not having any right or entitlement over the said land, approached the respondent 2 l authorities seeking paJrment of compensation amount in his favour, by making a false claim, which constrained the petitioner to institute O.S.No.379 of 2016 on the file of the learned Principal Senior Civil Judge at Warangal for the relief of declaration artd perpetual injunction, along with an application seeking od inteim injunction re straining the defendant authorities therein from releasing the compensation amount in favour of respondent No.6 herein. The grievance of the petitioner is that pending adjudication of the said suit, the respondent authorities are trying to disburse the compensation amount in respect of the subject larld in favour of respondent No.6. Considered the submissions of learned counsel for the parties and perused the record. Since it is stated that O.S.No.379 of 2016 frled by the petitioner seeking declaration and perpetual injunction in respect of the subject land, is pending before the Civil Court, this Court without expressing any opinion on the merits of the matter, deems it appropriate to dispose of the writ petition by directing the tand Acquisition Officer-cum-Revenue Divisional Officer, Warangal Division i.e., respondent No.4 herein not to disburse the compensation amount, in respect of the subject -,.) -- "--7 / -) land, till the disposal of o.S.No.379 of 2oL6 pending on the hle of learned Principal Senior Civil Judge at Warangal.
