BHASKAR REDDY WRIT PETITION No.3690 oF 2025 ORDER: The writ petition is filed seeking following relief: ".. .pleased to issue an appropriate Writ, Oider or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.2 to 4 in not considering the Dharani Application of the petitioner vide App[ ication Re f No. 24005 7924 I dated 24.08.2024 for mutation of petitioners name as successor and for consequential issuance of pattadar passbook to the petitioner in agricultural land admeasuring Ac.0-23 Guntas in Sy.No.6AlAA2 situated at Vattinagulapalle Village, Gandipet Mandal, Ranga Reddy District, as being illegal and arbitrary and voilative of principles of Natural Justice and in contrary to the Telangana Righs in Land and Pattadar Pass Books Act,2020, consequently direct the respondents to mutate the name of the petitioner as Successor and to issue pattadar passbooks in respect of his agricultural land admeasuring Ac.0-23 Guntas in Sy.No.6AlAA2 sinrated at Vattinagulapalle Village, Gandipet Mandal, Ranga Reddy District, by considering his the Dharani Application of the petitioner vide Application Ref No.2400579241 dated 24.08.2024 and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances oI the case."

It is stated that initially the father of the petitioner i.e., Mr. Mangalaram Ramulu was the owner and possessor of the land admeasuring Ac.0-23 guntas in Survey No.6AlAA2 situated at Vattinagulapalle Viltage, Gandipet Mandal, Ranga Reddy District. The name of the father of the petitioner was recorded in the revenue 2 records and he was issued pattadar passbook vlde passbook No.463428 and patta No.958. It is further stated that father of the petitioner died on 08.08.2010 leaving behind the petitioner and his sister as his legal heirs. After the death of his father, petitioner approached respondent Nos.2 and 3 for mutating his name in revenue records and for issuance of e-pattadar passbook in respect of the subject land as per the provisions of the Telangana Rights in Land and Pattadar Passbooks Act 2020 (for short 'Act 2020') by submitting online application bearing No.2400579241 dated
24.08.2024 through Dharani portal. The grievance of the petitioner is that even after receipt of said application, respondent authorities are not conducting any enquiry for mutation and issuance of e-pattadar passbook to the petitioner in respect of the subject land, despite the Tahsildar being conferred with the power of granting succession, survivorship, inheritance or change in revenue records on application being submitted duly enclosing joint agreement specifoing individual shares after arriving at consensus by the parties as per Section 6 of the Act 2020.
3. Mr. L. Ravinder, learned Assistant Government Pleader for Revenue, has not disputed the issuance of the pattadar passbook to --v/ 3 the father of the petitioner in respect of the subject land and submitted that appropriate action will be taken on the application of the petitioner, in accordance with law.
4. In view of the above, this Court deems it appropriate to dispose of the writ petition, directing respondent Nos.2 and 3 to consider the online application of the petitioner bearing No.2400579241 dated
24.08.2024 for mutation of his name in revenue records for issuance of e-pattadar passbook in respect of the land admeasuring Ac.0-23 guntas in Survey No.6AlAA2 situated at Vattinagulapalle Village, Gandipet Mandal, Ranga Reddy District, by issuing notice to all concemed/interested persons, and pass orders, by giving opportunity of hearing to all persons, in accordance with law, within a period of eight (8) weeks from the date ofreceipt ofa copy ofthis order.
5. With the above observations, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
