KADIRI KRISHNAiAH presented this Petition under ,\rticle 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue appropriate, writ or order or direction more particularly one in the nature of WRIT OF IVIANID,{IMUS declaring the inaction of the respondents in issuing the Proc. Rc. No. 26101tG412016, dt 15-10- 2025, without following the due process of law more Particularly in considering the candidature of the petitioner for promotion to the post of professor of Nursing by listing the petitioner in the above proceedings and also the rerspondents have not filled up the Roster points of Scheduled Tribes in promotions c,f Lecturer of Nursing, vide Proc. Rc. No. 430791G412024, dt 26-09-2022, Rc. No. 220101G4120115, dt 31- 08-2019, vide Rc.427611G412022 dt 05-09-2022 of Assistant P'ofessor of Nursing, vide Proc. Rc. No. 427611G412022 dt 03-09-2025 for Assistant f)rofessors are liable to be reviewed and directed to the respondents to consider tlr<: candidature of the petitioner to the post of professor of Nursing by set the above prr:ceedings dated 15- 10-2025 of the as illegal, arbitrary, unjust, unconstitutional, unfair, violation of the provisions state sub-c,rdinate service rules and against to the principles of the natural justice and consequently direct the respondents to implement the rule of reservation more particularly filling up the prescribed roster points for Schedule Tribes by setting- a-side the above impugned proceedings in the interest of justice. AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of DR. Professor, R/o GCN, Rajanna Siricilla, Telangana. are directed to show cause on or before 29.12.2025 to which date the case stands posted as to why in the circumstances set out in the petition and the affidavit filed therewith (copy enclosed) this WRIT PETITION should not be admitted. lA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to suspend the impugned proceedings vide Proc. Rc No. 430791G412024, dt 26-A9-2022, Rc. No. 226101G412A15, dt 31-08-2019, vide Rc.427611G412022 dt 05-09-2022 of Assistant Professor of Nursing, vide Proc. Rc.No. 427611G412022 dt 03-09-2025, until disposal of the main writ petition in the interest of justice, pending disposal of WP No. 35424 of 2025, on the file of the High Court. The Court made the followins ORDER: Notice before admission. Learned Government Pleader for Services-l takes notice on behalf of respondent Nos.1 to 3, waives further notice and seeks time to file a counter affidavit. Registry is directed not to take out further notices to respondent Nos.l to 3, in view of the above waiver. Learned counsel for the petitioner is permitted to take out personal notices to respondent Nos.4 to 14 through Speed Post with Acknowledgment Due and to file proof of service in the Registry by the next date of hearing. l.' Learned counsel for the petitioner submits that the petitioner, belonging to the Scheduled Tribe community, was initially selected and appointed as Staff Nurse by direct recruitment in Zone-V, vide proceedings dated 14.02.2Afi. Subsequently, she was promoted as Head Staff Nurse and later as Lecturer, and is presently working as Assistant Professor. While so, on
3.9.2025, respondent No.3 had issued a provisional seniority list of Lecturers in Multi Zone-ll, wherein, the petitioner's name was strown at Sl.No.48. However, without following the Rule of Reservation as mandated under law, the respondents prepared the impugned fina! seniority list vide proceedings Rc.No.26101lc4l201$ dated 15.1O.2025, without includingl the petitioner's name. Therefore, learned counsel seeks indulgence of this Court to suspend the operation of the impugned final seniority list dated 15.10.2025. Learned Government Pleader, on instructions, :submits that after bifurcation of the State, pursuant to the new Presidential Order,2018, the posts of Lecturer (Nursing) and Assistant Professor (Nursingr) were designated as Multi Zonal posts. Consequently, the roster points comrnsnced afresh from during the panel year 2021-22, and as per the Rule of Re,servation and the Telangana State and Subordinate Service Rules, 1996, 60/,, )f the posts were earmarked for the Scheduled Tribe (ST) category at roster pcint Nos.8, 25,33, 58, 75, and 83. Accordingly, during the panel year 2021-22, the Departmental Promotion Committee, taking into account the seniority, eligibility and community status of the petitioner, considered and appro,red her name for promotion to the post of Lecturer (Nursing), duly placing her name at Roster Point No.48, in accordance with the Rule of Reservation applicable at that time. Subsequently, the tlule of Reservation for Schedule Tribe categony was enhanced to 10% vide G.O.Ms.No.33 dated 30.09.2022, effecLive from the next panel year, i.e.,2022-23. However, the petitioner was alreadl' promoted during the panel year 2021-22. It is further submitted that during the panel year 2A24-25, the Departmental Promotion committee, taking into accourrt the seniority, eligibility and community status of the petitioner, had considered and approved her name f,cr promotion to the post of Assistant P'r,lfessor (Nursing), and she was placed at Roster Point No.48, duly implementing the 10% reservation for the Scheduled Tribe category. Hence, there is no deviation. lt is further submitted that the petitioner's promotions as Lecttrrer (Nursing) and Assistant Professor (Nursing) were based on the appnit:able reservation policies and roster system, and she had benefited from the same. lt is further submitted that the petitioner herein was promoted as Assistant Professor (Nursing),on 03.09.2025, and since she has not completed the minimum qualifying service of (2) years in the present cadre, she is not eligible for consideration for promotion to the post of Professor (Nursing). Having regard to the above made submissions, this Gourt is of the prima facie opinion that the matter requires a detailed consideration, for which, a comprehensive counter affidavit from the respondents is essential. Therefore, this Court is not inclined to grant any interim relief to the petitioner, at this stage. However, it is made clear that any promotions to the post of Professor (Nursing) in pursuance of the impugned final seniority list in Rc.No.261011G412016 dated 15.10.2025, shall be subject to outcome of the present writ petition.
