5. In Rajendra Kumat Barjatya and another vs. U.p. Avas Evam Vlkas parishad and others2, the Honble Supreme Court while observing that constructions put in vioiation of or deviation from the building plan approved by the local authority ald the constructions which are audaciously put up without any building planning approval, cannot be encouraged, has issued following directions: _up - '21. Since, it is stated that house is existing in the subject property for almost five (5) years and petitioners have purchased the subject property under registered sale deed, this Court deems it appropriate to dispose of the writ petition, directing respondent Nos.2 to 4 to follow the guidelines issued by the Honble Supreme Court and also the due procedure as prescribed under law, for removal of illegal constrLrctions. 7 . With the above observations, this Writ Petition is disposed of. No order as to costs.
