2. Since the issue raised in these writ petitions is one and the same, they are being disposed of by way of this common
3. Heard Sri P.Suresh, learned counsel for the petitioners and leamed Govemment Pleader for Land Acquisition appearing for respondent Nos.l and 9.
4. With the consent of learned counsel for the parties' the writ petition is being disposed of at the stage of admission' 2
5. Learned counsel for the petitioners submits that petltioners have purchased the lands to an extent of Ac.0.36 gts. in Sy.Nos.g 1/6al3, Acs.0. I 5 and I .00 grs. in Sy.No.9 l/es, through registered sale deeds dated 04. lO.2023 from the original owners by paying valuable sale consideration and since then they have been in possession and enjoyment of the subject property. He further submits that the respondent authorities witl.rout issuing notice and without following the due procedure as contemplated under law, are trying to take possession of the subject property for the purpose of establishing pharmacity. .fherefore. Petitioners have submitted representations before respondent No'9 on 28.0r-2025, requesting him to issue norice to them, before initiating land acquisition proceedings. Inspite of the same, respondent N.9 has not taken any steps to consider the representations submitted by the petitioners and the action of respondents No.9 is gross violation of principies of natural J ustlce
6. per contra, Iearned Government pleader for Land on the instructions furnished bv Acquisition) *basing J respondent No.9, submits that the respondent authorities initiated proceedings exercising the powers conferred under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2Ol3 (herein after called as 'Act 30 of 2Ol3') and issued notification under Section I l(1) ofthe Act 30 of 2013 and thereafter, passed award on 3O.04'2022, aft'er following due procedure as contemplated under the Act 30 of I \ 20 13, He further submits that the petitioners purchased the t I subject property, subsequent to initiation of land acquisition proceedings under the provisions of the Act and passing of the award. Hence, the writ petitions filed by the petitioners are not maintainable under law.
7. Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that petitioners are claiming rights over the subject property, pursuant to registered sale deeds dated
04.10.2023, whereas respondent No.9 had initiated land acquisition proceedings on 2O -06.2018 and passed award on
30.04.2022. Hence, this Court is of the considered view that 4 the petitioners are not entitled fbr the relief sought in the writ petitions. However, liberty is grantecl to petitioners to avail the remedies as available under law. 8 Accordingly, the writ peritions are dismissed. No costs.
