I 8241. 1a245. 18316, 18708 & 18719 of20o,6 COMMON ORDER: These writ petitions are liled seeking following relief: ".........to issue an appropriate writ, direction or an order more particularly one in the nature of "Writ of Certiorari" calling for the records relating to the orders dated 09.03.2006 passed in I.D.Nos.82, 83, 84, 85, 86, 87, 88, 89, 90 and 91 of 2003 on the hle of l,abour Court-lll, Hyderabad........" 2 These writ petitions are flled by the District Treasury Oflicer, Mahabubnagar against the award of the Industrial Tribunal dated O9.03.20O6 passed in I.D.Nos.82, 83, 84, 85, 86, 87,88, 89, 9O artd 9l of 2OO3.

3. Respondents herein were appointed as Section Writers in District Treasury Office, Mahabubnagar on 03.O5.1985 and worked as such till 31.07.1987 and again appointed on

05.08.1987 and worked up to 14.O3.1988 and were dismissed and thereupon approached A.P- Administrative Tribunal in R.P.No.8633 of 89 and batch ald the said petitions were allowed. For implementation of the said orders, respondents frled W.P.No.4I24 of 7990 before this Hon'ble Court and in all the matters interim order was granted on 25.07.1990 and $ {. 1 ..1 2 finally disposed of writ petition by order dated 2g.O7.2OOO for ordering to comply with the order of Administrative Tribunal. Respondents herein sought for regtiarization of their post as cashier by filing W.P.No. 1O937 of l98Z and when the petition came for frnal hearing, it was represented by the Government that they have been regularized and accordingly this Hontrle Court passed orders on lT.l7.l98T by making interim order as hnal order but tlle rea.l facts is that the respondents herein were not regularized and they are out of emplo5,.rnent from

15.03.1988. However, respondents herein worked for more than 24O days of service and their services were terminated. After termination of respondents from service, petitioners herein engaged 17 workmen and their services were regularized. Respondents got issued legal notices ald they were received by the petitioners herein but there was no reply. Therefore, respondents herein filed petitions before the Industria-l Tribunal to set aside the termination orders as illegal since in violation of provisions of I.D. Act arrd to reinstate them with all benefits.

4. In a counter frled by the petitioners herein it is averred that the District Treasury Officer was permitted to engage persons on remuneration basis. Initially, 27 individuals have applied voluntarily and are entrusted with the work. After I NGO's strike was called off seven persons were asked not to attend the office frorn 29.12.79A6 arld remaining 2O persons were appointed as section writers and were terminated and they were in service for a period of seven months. For second time all tJle above ten persons were reappointed on

08.08.1987 ald worked up to 14.03.1988 and they were terminated from 14.03.1988. When they filed W.P.No.10937 of 1987 for regularization of service, as per interim order in that matter, respondents were re-engaged on sane terms w.e.f., 05.08.1987 and the said interim order was merged in the frnal order on 27.71.1987 in W.P.No. 1O937 of 1987. Government transferred the respondents herein from Social Welfare Pensioners Scheme to the Revenue Department ald issued notification through emplo5rment exchange, accordingly, 17 candidates were selected and their services were regularized as per rules issued by Government vide G-O.Ms.No.193 dated 14.03.1990. It is informed to the Hon'ble High court that there is ban on recruitment of a1l posts ald the case of the respondents herein in W.P.No.10937 of 1987 will be considered after the ban is lifted. It was contended that District Treasury Ofhce will not come under the dehnition of industry. \ t 4

5. Respondents herein were examined as W.W.1 in all the matters and got marked Exs.W.l to W.14. M.W.l is examined on behalf of the petitioners herein and Exs.M.1 to M. 17 were marked.

The Industrial Tribunal considering the oral and documentaqr evidence of both sides set aside the retrenchment order dated 14.03.1988 with a direction to reinstate the respondents herein as section writers with continuity of service with wages at Rs.375/ per month but without back wages and attendant benefrts and also directed to implement the same within one month and aggrieved by the order passed by the Tribunal, these writ petitions are ltled by the District Treasury Officer ald the Director of Treasuries ald Accounts. 7 . It seems that along with the batch of writ petitions hled by the District Treasury Offrce, the respondents herein also frled another batch of writ petitions questioning non-gralting of back wages to them but the said writ petitions hled for non-granting of back wages were dismissed conhrming the orders of the Tribunal and also in a common order dated

20.12.2019 in a batch of writ petitions passed by this Court it was held as follows: .:' 5 "In view of the submissions, this Court is of the considered view that when the awards passed by the Labour Court are confrrmed by this Court in W.P.No.8092 of 2008 and batch dated 25.10.2018, the same analog/ has to be applied in respect of the present writ petitions also. Therefore, there are no merits in t}re writ petitions and the sarne a.re liable to dismissed. Accordingly, the writ peLitions are dismissed confirming the awards dated 09.03.2006 passed by the Labour Court in I.D.Nos.82, 83, 84, 85, a6, a7, AA' 49, 9O and 91 of 2OO3 in the following writ petitions:

9. Admittedly, the depa-rtment as well as respondents herein before the I.D Tribunal preferred two batches of cases against the orders of the Industrial Tribunal. The respondents before ttre I.D Tribunal sought for back wages but it was not considered and the order of the Tribunal regarding the reinstatement with attendant benehts was conhrmed as such this Court opines that there is no need to go into the merits of tJ e case and to pass another order against the order of the contemporar5r Bench ald also of the considered view that the orders passed by the contemporary Bench holds good.
